Parts of Alabama immigration law blocked by federal appeals court

(CNN) -- A federal appeals court has blocked enforcement of parts of a controversial immigration enforcement law in Alabama.

The injunction issued Friday from the 11th U.S. Circuit Court of Appeals in Atlanta came after the U.S. Justice Department -- supported by a coalition of immigrant rights groups -- requested the legislation, known as HB 56, be put on hold until the larger constitutional questions can be addressed, a process that could take some months at least.

The 16-page order gives both sides partial victories, allowing some parts of the law to go into effect while others are temporarily blocked.

The Obama administration says the Constitution does not permit states to deter illegal immigration, saying an issue with foreign policy implications is the exclusive mandate of the federal government.

It’s beyond time for the States to step forward, and straighten out the Federal Government they contracted to maintain their Union.

From above, not that bad of a ruling:

Among the provisions temporarily blocked from being enforced are:

— One requiring state officials to check the immigration status of students in public schools;

— One making “willful failure to complete or carry an alien registration card” a misdemeanor for immigrants;

But the state will be allowed to enforce these contested sections:

— One requiring that police during “lawful” stops or arrests “attempt to determine the immigration status of a person who they suspect is an unauthorized alien of this country.” That provision is similar to other laws aiming to crack down on illegal immigration passed by other state legislatures over the past year.

— One barring state courts from enforcing contracts involving undocumented immigrants, if the hiring party had a “direct or constructive” knowledge that the person was in the country unlawfully.

— One making it a felony for illegal immigrants to enter into a “business transaction” in Alabama, including applying for a driver’s license or a business license.

Article IV

Section. 4.

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.

A large group of people illegally in the country could be considered an invasion force.

What hogwash - WHAT THE HELL does illegal immigration have to do with "foreign policy implications" ???

Foreign Policy concerns our relations between the United States and foreign States - NOT those that FLEE from foreign States [other than for political asylum reasons].

Once illegals hit our borders - it is Domestic Policy that controls. AND, once inside a State [such as Alabama] - State Domestic Policy controls [as long as it conforms to the Constitution] ...

This is bs...however, immigration laws are the feds responsibility however when the feds will not perform their constitutional duty...then the states have had to step in. As Governor Perry has done with the Tx Mx Border.

Grow up. Look at the info I posted back to you. Educate yourself on Texas and Governor Perry is having to do to protect your sorry A. This is an international border and you ought to be thanking God, Governor Perry is doing this.

Perry became Governor in late Dec. 2000, this legislation hit his desk in April 2001, it was veto proof. Now what our Texas Republicans did is get control of this issue. We have one of the toughest in state tuition legislation in the USA with a very few exceptions.

There are 38 states that have no legislation on in state tuition at all. So what does that mean...if it is NOT PROHIBITED IT IS ALLOWED. The illegal youngsters in those states receive in state tuition like any legal American student. The illegals in Texas have to jump through hoops to qualify for in state tuition. Whereas the legal Texas students do not.

I don’t give a shit what the other states allow or don’t, TX was the issue and we don’t usually go by “well all the other kids are doing it” around here, do we?

And I don’t need another AHOLE in the WH telling me what a mean hearted SOB I am. Grow up? Throw up is what this makes people want to do.

That’s today’s choice. A lot can happen between now and then. Hope it does. And no, Obama is not in that choice...not for me, anyway. Any dumb SOB that wants to walk around badmouthing me and my beliefs will not get me to do squat for them. Time for that crap is over.
