Troy Davis execution delayed while supreme court considers stay

The execution of Troy Davis was delayed temporarily by the US supreme court on Wednesday night in a dramatic intervention just as he was due to be put to death by lethal injection.

The last-minute decision caused confusion outside the prison in Jackson, Georgia, where family, supporters and civil rights campaigners broke into celebration as they believed the court had granted Davis a stay of execution.

But it quickly emerged that the delay was only temporary, while the justices considered whether to issue a stay.

Until that moment it seemed almost certain that Davis would be executed, as the Georgia supreme court had rejected a last-ditch appeal by Davis's lawyers over the 1989 murder of off-duty policeman Mark MacPhail, for which Davis had been sentenced to death despite overwhelming evidence that the conviction is unreliable.

A Butts County superior court judge had also declined to stop the execution.

Wow.

Didn’t hear Hollywood and all the anti-death-penalty hypocrites utter a word to try to prevent that execution.

I can’t imagine what gives.

MSMBC has been shameless. Almost 24 hours of coverage of this mans supposed innocence. Not one of the taking heads that are taking the side of the killer KNOWS THE FACTS of the 20 PLUS year death penalty case. NOT ONE. But, they all know he is innocent. The murdered is not mentioned. No one is standing up for him. NOT ONE.

Fallen Savannah police officer Mark Allen MacPhail was murdered while trying to help a beating victim, the first officer to reach his dying comrade recalled.

“Mark was a hero. That’s all there was to it,” said Sgt. David Owens.

They seem to love cop killers and murderers unconditionally for some strange reason and they have no problem killing babies either. All I can think of is they are warped beyond repair.

Why anyone would listen to them is beyond me. Just once it would be nice if they actually knew what they were talking about.

August 19, 1989, murder of Savannah, Georgia, police officer Mark MacPhail. MacPhail was working as a security guard at a Burger King when he intervened to defend a man being assaulted in a nearby parking lot. During Davis’ 1991 trial, witnesses testified they had seen Davis shoot MacPhail, and two others testified that Davis confessed to them. Although the murder weapon was not recovered, ballistic evidence presented at trial tied bullets recovered at or near the scene to those at another shooting in which Davis was also charged. Davis was convicted of murder and various lesser charges, including the earlier shooting, and was sentenced to death in August 1991.

In July 1988, Davis pled guilty to carrying a concealed weapon; he was fined $250 as part of a plea agreement in which a charge of possession of a gun with altered serial numbers was dropped.

A bullet was fired into the car and Michael Cooper, a passenger in the other car, was shot in the face, allegedly by Davis. Davis and Collins continued on, and later met Sylvester “Redd” Coles, who was arguing with a homeless man, Larry Young, over a beer near a Burger King restaurant in the nearby Yamacraw neighborhood.
Off-duty policeman Mark MacPhail was working as a security guard there and was shot when he attempted to intervene in the pistol whipping of Mr. Young.

MacPhail, age 27, the son of a U.S. Army colonel, was married with a 2-year old daughter and an infant son. He had joined the Savannah Police Department in 1986 following six years of military service as an army ranger. MacPhail had worked for three years as a regular patrol officer and in the summer of 1989 had applied to train as a mounted policeman.

At about 1:15 am, seeking to help Young who was being attacked in a nearby parking lot, MacPhail was killed. He had been shot twice, once through the heart and once in the face, without drawing his gun.

Davis and three of his family members testified during the sentencing phase. In a final address to the jury, Davis pleaded, “Spare my life. Just give me a second chance. That’s all I ask.” He told jurors he was convicted for “offenses I didn’t commit.” As the death penalty was being requested by the prosecutors, MacPhail’s family members and friends were not allowed to testify

As is too common in these cases the guy should have been in prision and not able to commit this crime. Having a firearm with the seriel number obliterated is I believe a Federal Crime punishable by 10 years in Federal prision. Again the SYSTEM lets another murder occur. All for just 250.00.
