CHICAGO, IL, August 31, 2011 (LifeSiteNews.com) An Illinois appeals court rejected on Friday an abortion remorse lawsuit, denying the womans argument that she is entitled to damages against the abortion clinic. The woman alleged that the clinic staff had a duty to tell her that she was terminating the life of a human being as a matter of biological fact.
Its sad that judges are willing to compromise a womans health, Georgette Forney, the co-founder of the Silent No More Awareness Campaign, an organization of men and women who regret their abortions, told LifeSiteNews.com.
If [the lawsuit] wasnt related to abortion, but to a transgender person who had changed their mind, [the court] would have been more understanding A womans pain isnt being acknowledged in order to protect the right to abortion, she said.
The plaintiff, identified only as Mary Doe, had an abortion at a Planned Parenthood clinic in Chicago in 2004, before which she says she had specifically asked a clinic counselor if her unborn child was a human being. Two years later, she filed a malpractice action against the clinic based upon the fact that the counselor had erroneously told her no.
Science is agreed that human life begins at conception, at which point a unique, living human being with its own genetic structure comes into being. Some abortion proponents justify abortion, however, by saying that the unborn child is not yet a person.
Doe alleged wrongful death of her fetus, intentional infliction of emotional distress and a violation of the Illinois Consumer Fraud and Deceptive Business Practices Act.
She said that she would not have had the abortion if the clinic had told her that she was terminating the life of a human being.
We echo the observation of the New Jersey Supreme Court (Acuna v. Turkish ruling), said Justice Rodolfo Garcia in the 16-page opinion. No court, regardless of where it sits, has found a common law duty requiring doctors to tell their pregnant patients that aborting an embryo, or fetus, is the killing of an existing human being.
The negative answer from the Planned Parenthood counselor to the plaintiffs question of whether there was already a human being in existence during the plaintiffs intake evaluation simply reflects the opinion of Planned Parenthood on when life begins, he said.
Does attorney, New Jersey attorney Harold Cassidy, expressed his disappointment with the courts decision, saying that he will ask the Illinois Supreme Court to hear the case.
All were saying in this case is if a woman asks for that information, she is absolutely entitled to it, he said. What has happened here is Planned Parenthood replaced her judgment with theirs by denying her the scientific facts and giving her their philosophical viewpoints.
That is the crux of the problem, the public has accepted Big Murder's definition of personhood.
I remember reading abortionists’ testimony to Congress a few years ago, in which they argued that a woman coming in for an abortion has a right to a dead fetus (I think the testimony involved taking measures to save fetuses who didn’t die inside their mothers during the abortion process).
A right to a dead fetus apparently does not encompass the right to know that a fetus dies during an abortion.

Where has this nitwit been since Roe v Wade? I think the suit was frivilous.
You walk into an abortion factory, have an abortion, and then sue because they did what you paid them to do? Forgive me but I have very little sympathy for that.

I can understand the woman’s regret for murdering her baby.
But she was pregnant and didn’t realize that the child growing inside of her was a human being?
What did she think it would eventually be born as if she didn’t abort? A frog? A platypus? Perhaps a Salamander?

Initially, my thought was about the same, but there is an argument to be made that the abortion industry has waged a campaign to mislead their “consumers”. If the tobacco industry can be held liable for claiming cigarettes didn’t cause cancer when it was common knowledge that they did, then why not try to hold the abortion industry similarly accountable?
More importantly, a side effect of pursuing this kind of case is that you might be able to press the court into ruling on whether the fetus counts as a human being, since that would be one of the facts of the case.
Are you not aware of Conners law? That was passed by Congress and signed by Bush. It states that a fetus is a child (ie human being) from the time of conception. It makes killing a fetus (a child in the womb) a crime. Scott Peterson was convicted of double homicide.
No, I knew that many states had laws allowing murder prosecutions like that though. Obviously, though, the laws must be written to be useless in terms of challenging abortion statutes, or this wouldn’t be an issue.
So we have this towering artchitecture of law, Constitutional, civil and criminal, judicial rulings, precedents, legislative intent, policy and enforcement, all built on a firm foundation of ...absolutely nothing.
When she went in, she WANTED to believe the lies they told her, even though she, and everyone else, knew deep down that it was a lie.
If she’s under 30 she’s never heard anything BUT lies.
