The police car was driving around with the lights out on city streets. I know that Wisconsin has a special statute that gives game wardens the special privilege to do this without any liability. Does anyone know if Ohio has a similar special privilege for Police officers?

So the cop was spotlighting I guess :)

One comment on that article from a police officer states that every car he stops has a gun in it. I guess Officer Harless hasn’t learned that yet.

That cop made so many procedural mistakes, I stopped counting. And anyone that thinks it's okay to threaten or shoot someone just because they're stupid doesn't need to be wearing a badge.

I’m starting to worry about the behavior of police in this country,especially in smaller cities and towns where the talent pool.compensation, training ,and weeding out processes may be inferior. There seem to be more and more of these vids with out of control LEOs treating the public in threatening manner.

The ludicrous, criminal behavior of some cops will eventually result in the death of those cops and perhaps some innocent bystanders as well. The American public, once alerted to what some of their police have become, will trust NO ONE who makes a traffic stop...either a legal OR illegal stop. And bullets will fly at the slightest provocation. Perhaps that’s what it will take to rectify the problem.

REMEMBER: Armed, we are citizens. Unarmed, we are SUBJECTS. And a few criminal cops are treating far too many like subjects. It’s an attitude which will not lead to a good ending.

In general, under police powers, the police may ignore numerous misdemeanor behaviors in the performance of their duties. For example, an officer may speed to catch a speeder. An officer may commit trespass to catch a burglar. Therefore, an officer may drive around without his lights at night to enable him to sneak up on wrong doers. At the same time his liability if something goes wrong is much higher because of his choice to ignore the law. That isn’t the issue here.

Where is the supervisor who is supposed to review these dashboard Cameras? An officer has an obligation to treat citizens with equal respect. Dirt-bags and Bank Presidents deserve the same services. The demeaning language alone, without the threats, should have been enough to have the officers fired. Watching the officers try to trump up some charge because they aren’t able to provoke an angry response from the citizen is enough to charge them criminally.

Police are a conduit for the ethically challenged to enter the Criminal Justice System. “Protect and Serve” is a very misused piece of propaganda. Police must never be permitted to be the judge or arbitrator of what is right and wrong otherwise we really don’t need courts.

I've been worried about the behavior of police and other federal officers over the entire Country. It seems they forgot laws and that they work for us. If they can't stand the heat of the job then quit. Get your as@ off my streets.

FYI - UPDATE UPDATE 7/22/2011: Canton Police announced Thursday that the officer was relieved of all duties in June following an internal investigation complaint filed in this matter. The local Canton Repository has done some additional investigatory work into the officers and an excellent analysis of the video / audio we posted. The video and story has gone both viral and national crossing over to websites not typically affiliated with the pro-gun movement. Shortly after 7:00pm Thursday our website could no longer handle the volume of visitors we were receiving. We promptly quadrupled the resources behind OhioCCW.org in light of the popularity of this story.

United States Code, Title 18, U.S. Criminal Code §ection 241:
Conspiracy against rights

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Ohio Revised Code:
525.13 INTERFERING WITH CIVIL RIGHTS.

(A) No public servant, under color of his office, employment or authority, shall knowingly deprive, or conspire or attempt to deprive any person of a constitutional or statutory right.

(B) Whoever violates this Section is guilty of interfering with civil rights, a misdemeanor of the first degree.
(ORC 2921.45.)

Daniel Ray Harless of Canton, OH better disconnect his phone. Pipl and Zabasearch shows his wife’s name as Kristina and it lists her address and phone but not his. He didn’t think the privacy thing out too well.

In Ohio the police can’t even sit on the side of the highway and run radar without lights on. There are no unmarked cars either.

Every motor vehicle should at least as an option, video capability as a safeguard against the government. These cameras should be of the type that can upload to the internet in real time.

State Trooper in Ohio, when parked on the highway for the purpose of tracking speeders with their radars and lasers must have their lights on at night. I don’t know if that applies to other Ohio cops as well.
