LAFAYETTE, NY (WSYR-TV) New York State Troopers say one man is dead after a motorcycle crash near McClary Road and Route 11 in LaFayette on Saturday.
New York State Police say 55-year-old Philip Contos of Parish was part of a protest against motorcycle helmets.
Police say several motorists from the group ABATE (American Bikers Aimed for Education) of Onondaga County had come together to make a point that they didn't need their helmets.
The group was driving south on Route 11 in Lafayette around 1:30 p.m., headed toward Lake Como, just south of the Finger Lakes.
Police say Contos suddenly hit the brakes and lost control of the motorcycle.
According to troopers, Contos was thrown over his handlebars and hit the pavement as his 1993 Harley Davidson motorcycle skidded toward the guardrail.
Contos was still alive when crews arrived at the scene and was transported to Upstate University Hospital, where he was pronounced dead.
According to police, Contos was not wearing his helmet, as required by law. Witnesses say this decision was part of the protest.
Police say that based on evidence at the scene and from doctors, Contos would have survived if he had been wearing a DOT-Approved helmet.

The argument posited is that public bureaucracies create a false need which then requires liberties to be limited in order for that false need to be fulfilled for the good of society.
It’s big picture stuff. It’s not about motorcycles, though in this case is manifested in helmet laws.

You cannot claim the right to liberty, without taking responsibility for the risks you want to undertake, and then have society assume responsibility for you, if it doesn’t turn out well for you.
That is a child’s viewpoint, to demand the right to pet the dog, but expect mommy to protect them when the dog snaps.
If you want to have the right to do what you want, you had better have the means to cover your sorry arse, because if you don’t thay means society is going to have to back you up and that means society has the right to demand you adhere to certain practices.
You never said you did conduct yourself in a safe and responsible manner, so I can’t assume you do.
But I can assume that, if you’re crying for liberty from societal obligations on something like wearing a motorcycle helmet, that there will be times when you want to ride a motor bike, without wearing a helmet, which means that you are choosing times to be stupid and you are also choosing time when you want society to pick up after you, if it doesn’t work out. You want to be free, but provided for, which is contrary to being a real Libertarian.
You can’t plan for everything, but you certainly can plan for consequences that are certainly foreseeable, like wearing a motorcycle helmet when you ride a motorbike, just in case some guy juts out of an alley and you can’t prevent a collision.
Yea, you can plan for that possibility.

I specifically advocated taking responsibility along with the liberty.
To underscore the point I stated - as federal “safety net” programs fail it will result in an increase in the opportunities to take responsibility inherent with the right to liberty.
