Obama administration calls for halt to Texas execution

WASHINGTON — The Obama administration took the unusual step Friday of asking the Supreme Court to stop Texas from executing a Mexican citizen convicted of raping and killing a 16-year-old girl.

The administration said the court should delay the planned July 7 execution of Humberto Leal for up to six months to give Congress time to consider legislation that would directly affect Leal's case.

The 38-year-old native of Monterrey wasn't told he could contact the Mexican Consulate after his arrest in the murder of Adria Sauceda. His lawyers say police violated an international treaty by not telling Leal he could have consular assistance.

SCOTUS ruled against Bush. Obama probably knows he will lose this one too, but just might be pandering for votes and bodies to work for him in 2012.

October 07, 2007 Texas argues that neither the international court nor Bush has any say in Medellin's case. Medellin was born in Mexico, but spent much of his childhood in the United States. He was 18 in June 1993, when he and other members of the Black and Whites gang in Houston encountered two teenage girls on a railroad trestle. The girls were gang-raped and strangled. Their bodies were found four days later. Medellin was arrested a few days later. He was told he had a right to remain silent and have a lawyer present, but the police did not tell him that he could request assistance from the Mexican consulate.

Does the treaty REQUIRE the defendant to be notified that he has the right to contact the consulate? If not, then there is no reason to stop the execution

The SC ruled it is not binding on the states until the congress passes legislation, in this particular case, to adhere to the notification requirement.

That's why everyone is just 'asking' for Perry to postpone the execution. He has no legal obligation to do so. This POS has had every appeal denied. Time for him to go the way of his victim.

IF the SCOTUS said that they could NOT intervene in a stolen election in NJ due to it being under the States jurisdiction and Constitution... and they did... and laut stole an election... then the Fed has no right to tell the State of Texas to stop an execution within the Constitution of and under Law of Texas. Obama has two young daughters and still comes up with this crap. It’s kind of like Dukakis saying he is still against the death penalty even if it was his wife who was raped and murdered. The president is asking the USSC for a delay on behalf of Congress, why the hell isn’t Congress asking on behalf of Congress? Who the hell does this guy think he is?
