WI - Unions file suit to halt collective bargaining legislation (in Federal Court)

Madison - One day after the Wisconsin Supreme Court ordered the reinstatement of collective-bargaining legislation that potentially affects thousands of public-sector employees, a coalition of unions filed suit in federal court seeking to block it.

The Wisconsin State AFL-CIO on Wednesday joined a number of other unions seeking to halt Gov. Scott Walker's controversial collective bargaining legislation.

The groups include the American Federation of State, County and Municipal Employees (AFSCME) Council 24, AFSCME Council 40, AFSCME Council 48, the American Federation of Teachers (AFT), the Wisconsin Education Association Council (WEAC), the Wisconsin State Employees Union, The Wisconsin State AFL-CIO and the Service Emplloyees International Union – Health Care Wisconsin (SEIU).

In a statement, the groups said they filed the suit because the collective-bargaining legislation "denies hundreds of thousands of public employees their right to collectively bargain for a better life. The groups challenge the constitutionality of the state’s Budget Repair Bill which would destroy collective bargaining rights for all but a select group of public sector workers."

The suit, filed in the Western District of Wisconsin, says the legislation violates the 1st and 14th amendments "by stripping away basic rights to bargain, organize and associate for the purpose of engaging in union activity, which have been in place for the last half century."

The case was assigned to Federal Judge William M. Conley

Since offices have been served with far-reaching Open Records Requests from the liberal Madison organization One Wisconsin Now regarding the events of February and March, I came across a sampling of some of the threatening emails we were treated to on a daily basis. In case you are interested, pasted below are actual uncensored emails from some of the protesters. BEWARE: Many of the emails below contain foul and offensive language. Again, this is just a sampling of many of the emails offices received.

Whoever said “Truth is stranger than fiction” certainly was right when speaking of Madison. Last week as I left work and was heading to my car, there was some type of a “Free the Weed” Pot Rally going on. There is another Blue-Fisted rally going on right now in the Rotunda. “Tent City.” It’s never a dull moment here.

Thank You, Outstate Wisconsin Taxpayers, for being a voice of reason and common sense as we try to get Wisconsin back on the right track, create jobs, honor parents’ rights, and pay the bills.

My wife, daughter, son and I witnessed the event as you crossed the street returning to the capital around 1:45 pm today (6.14.11)with the goof balls wearing pink dresses chasing you and the dirt bag in the hat blowing the air horn at you. That air horn was very loud and only 6 to 8 inches from your ear, my family and I hope you were not injured. I took these two pics of him immediately after the incident, these were taken even before you made it up the steps to the capital. I was unable to get his name because he was a little upset I was taking his picture. If you need anything regarding this incident in the future just let me know.
Also I would like to thank you for all your efforts as a Wisconsin Senator.

Subject: How to Forward a Threatening Email to the Authorities
Importance: High

Due to feedback from legislative offices, LTSB developed a process that will allow each legislative office to be the sole point of contact regarding threatening emails. No one but your office will have access to your email. To be clear, under the previously suggested process, DOJ was never going to access your email. LTSB would only have provided IP address information for emails that offices reported as threatening.

The New Process

By following the process below, each legislative office will be able to provide authorities with the necessary information required for an investigation. Specifically, this process will keep the email header information intact by sending the threatening email message as an attachment.

Here is how to properly forward a threatening email to the authorities:

1. Create a new email message

2. Drag the threatening email into the body of the new message. It will show up as an attachment.

3. Send the email to: Ed Bardon (DOA): ed.bardon@wisconsin.gov

As a reminder, per the Chief Clerks, each office should immediately notify local law enforcement in their district of any threatening emails received.

Please note: If the threatening email contains illegal images, you should not forward the email message at all. Instead, contact the proper authorities.

If you have recently received threatening emails, please resend them to the authorities using this process.

Of course the federal courts can get involved. e.g. if a state made it illegal for a private citizen to own a gun, that would violate the US constitution. And that is the problem here with the lawsuit and why it cannot prevail. What the state did does NOT violate the US Constitution.

The federal courts are not bashful about "legislating from the bench" whether or not the issue at hand is subject to an interpretation of Constitutional principles. Over and above federal courts there are thousands upon thousands of bureaucrats, hidden away in a myriad of federal agencies (DOE, EPA, Dept of Commerce, &c. &c. ad nauseum) who spend their lifetimes grinding out regulations that have the power of law without ever being voted up or down by either federal or state legislatures. None of those are intended to make our lives more comfortable.

I hope you are right and their attempt at a lawsuit is tossed at first brush. However, I fear that an activist judge may well undertake a long and drawn out effort which will ultimately have to be heard by the USSC. The union tactic may be to play for a delay rather then an outright win.

I’ve always felt that the bill had possible equal protection problems because it does not include public safety unions. The reason they were not included is that they are too powerful and the public is too sympathetic to them. I don’t know if this is a good enough reason to not treat them like all other public employees.
