Alabama Passes Mandatory E-Verify & Immigration Enforcement Bill

An Alabama House and Senate conference committee agreed on a new bill, which both chambers have already passed, that requires the use of E-Verify by all businesses in the state and includes several immigration enforcement provisions. Should Gov. Robert Bentley sign the bill into law, it would become one of the largest state crackdowns on illegal immigration in the country.
The bill requires all businesses, public and private, to begin using E-Verify effective April 1, 2012. Businesses that do not comply face suspension of its business license and loss of employee expensing for state income tax purposes. All state and local businesses must be in compliance by Jan. 1, 2012 or face loss of business license and contract.

But what would be the Constitutional basis for making it mandatory at the federal level? Would this infringe on the 10th amendment? I would support Lamar Smith’s bill if someone could explain the Constitutional basis for it.
You bet I dare. You would empower a critical element in a budding nationwide electronic police state. What YOU don't see is what happens when these powers you think are so non-invasive are combined. What happens when E-Verify abets a massive industry in fake ID? You would add biometric-ID to your requirements. What happens when you want tracking food distribution in case of terrorism? You would add the National Animal Identification System, capable of tracking the movements and transactions involving 300 million animals. Oh, but what about other kinds of food? Did you know that SB-510 mandated tracking of all food, from farmer to store (there's a minimum size of operation, but that won't last)? Let's see, the capability to track 300 million people plus biometric ID. Got it. A national sales tax? Why, reporting every transaction to the Federal government! What happens when it becomes plain that it is easy to construct weapons of mass destruction from commonly available goods. Why, you would preclude anyone with such associations from buying those goods, putting a search of the purchaser's records (without probable cause) before they are allowed to buy. Think that radical? How much different is that from E-Verify? What happens when sexual predators released from jail? How about GPS bracelets tracked by cell phone. Now, scale that up to the fact that every cell phone now has a GPS receiver.
All those software systems are now in place or getting there. They'll be able to monitor where you are, where you go, where you live, what you buy, and where you can work, even what you say. They'll even have Future Attribute Screening Technology (FAST) to detect what you might be thinking. Where they want you will be in their Sustainable Developments surrounded by "greenbelts" with no way out. The bulk of suppliers will be offshore.
They'll soon have all the tools in place for discretionary refusal of any activity necessary for survival. For any community that refuses, all the government will need to "enforce compliance" under threat of mass extermination is to cut off the electrical power. No power, no food, no fuel, no water, or sewerage treatment. The longest a city might last is a couple of weeks and there would be total panic. And please don't bother telling me it's never been done because it already has been done by cruder means throughout history. Such systems for monitoring and control were the stock in trade of the NAZI Party. Such systems are attendant to both the Brady Bill, the PATRIOT Act, and E-Verify, and please don't tell me that they won't be abused because they already have been, your bogus accusations notwithstanding.
With each such step, we allow the Feds to put the pieces in place. E-Verify is exactly such a step. Why advocate for such a system when it is totally unnecessary? You swore an oath to the Constitution. Where among those enumerated powers is the equivalent of E-Verify? There is nothing in Article I Section 8 that allows the Federal government to intervene between an employer and an employee. Nothing. What you are doing is conflating "border enforcement" with an illegal usurpation of powers inherent to the enforcement tool.
The excuse used to justify many of these accruing powers is terrorism. Why not start by getting rid of illegal aliens, many of whom are Muslims? If you think a bounty system wouldn't be quick, I've got news for you.
I proposed bounties to capture illegals, a proven citizen-driven system, one that is fully supported by the Constitutional letter of marque, and with checks and balances already in place found in civil liability. You scream "vigilantism!!!" and "NAZI" as if anything out of the complete control and execution of an almighty State legally equipped with both police power and "sovereign immunity" is not to be tolerated. You are empowering that police state because you have no faith in your fellow American citizens. You bandy your military record is if that has anything to do with the constitutionality of these accruing powers. As far as I am concerned, until you accept that E-Verify is in violation of those enumerated powers, you are a traitor to your country and your oath. I suggest you repent.

Photo matching is activated automatically if an employee has presented with his or her Form I-9 a:
I-551, (Permanent Resident Card)
Form I-766, (Employment Authorization Document), or
U.S. passport or passport card
If no photo is available, the case will either automatically skip photo matching or “No Photo on this Document” may display in place of a photo.
The three cases mentioned above require a photo to already be on file with the federal goverment. Thus, the photo with the I-9 can be matched against the photo already on file with the feds.
So, yes, not every application can or will be photo matched, but it is a beginning. Green card holders, people with work visas, etc. can be checked as well as amcits with passports. If the applicant has phony or counterfeit documents, it will be discovered in those cases.
I agree, photo matching in E-verify could do a lot of good, and in the future it could be improved, with photos required for a SSN, voter registration card, etc., and inter-agency cooperation. The problem is the leadership in the white house and DHS. They seem to prefer lots of “undocumented” future leftist voters to remain and work here, and don’t want the states to “interfere.”
