Menlo Park Cops Raided Wrong House, Says Claimants in Lawsuit

When Menlo Park police officers busted into an East Palo Alto home and pointed a firearm at a two-year old girl in November, they had the wrong house, say the two homeowners, who are filing a $500,000 claim against both cities.

The East Palo Alto City Council rejected the claim on an unanimous vote. The Menlo Park City Council has yet to consider the case.

Police terroize family, cause personal injury, and property damage by raid a home without a warrant because they got the wrong address, yet no one has been punished, fired, or re-trained. Then, the family states the officers involved have harassed the family after the raid.

Police are above the law when it comes to civil and criminal responsibility for their actions.

Yes. It seems everyone - left, right, whatever - is getting tired of it, but not a lot is being done about it.

Everytime I read about cops pointing their weapons at little children it pisses me off. How is a 2 year old a threat? How can any rational person do that. What’s he gonna do if the 2 year old doesn’t follow instructions? Shoot them?

Another example of sloppy reporting.

Whichever department raided the house needs to take responsibility. Compensate the family, make a public apology on the evening news, and fire the lead investigator at the scene.

What I don’t understand is why there is never professional or criminal repercussions for the officers involved in the illegal raid, personal/property damage?

Why must the tax payer always be on the hook for the civil lawsuit?

If you or I broke into someone’s home early in the morning and did the same thing, we would be in jail. That, is essentially what the police did in this case without any lawful justification. Plus, throw in the post-incident harassment alleged, makes you wonder.

So much for the ‘ample civil remedies’ referred to by the Indiana Supreme Court, and, at least by implication, by the USSC, in recent rulings....

What does that mean exactly. So the City Council rejected the claim on a unanymous vote.

I thought a Judge and Jury handled these cases.

Can a City Council just vote not to pay?

Yes, the might very well do that. The Denver cops shot a 9 year old in the back with a shotgun. Claimed it was an accident.

If you or I were to mistakenly kill someone's mother, son, father, brother because of negligence, we would be in jail.

If you or I were to carry a Glock on our hip we would be in jail.

Etc., etc., etc.

The list is long, but yeah, it seems the law seems to have been warped to put these particular government employees' lives, health and well being above the rest of us.

Try filing a citizen complaint against a cop. I did here in a little NorCal town a couple of years ago. You can’t imagine how they try to make you the bad guy. I was threatened by the Sheriff’s Dept. with arrest and prosecution should my claim be found to be fraudulent. I was “interviewed” in a windowless room at the PD HQ with the whole session taped, and I was told just how bad this would be for the officer’s career should he be found to be at fault. Then when it was clear I had a legitimate case, they tried for more than a year to ignore me. Had to take it to the city council to get them to force the police chief to even meet with me. They are not your friend, they are not there to either protect or to serve you. They are nothing more than union thugs in blue uniforms who have the right to kill you if they feel like it.

There shouldn’t be any such thing as a “police raid” of someone’s home. Never.

Serve the warrant and request entry from the occupants, no firearms drawn unless there is an ACTUAL threat.

File suit on different aspects vs homeowner against the cops. Hit the lcal goobermints insurance an risk management etc... Such inept operations not only endanger the populace but also members of the police department.

Go after the investigators the planners the supervision the clerk who typed the damn address on the form.

Did the undercover agent do a driveby an confirm the target sight....

Hell did they even pick up their smartphone an google earth the address an look at the target structure an compare notes in a pre raid briefing for all involved ?

Total cow crap what cops who screw up so bad that they get a opportunity to do it again and again....

If a person working for a company packages a dangerous item improperly that person an his company is made to compensate for they’re mistake. Time well past for such to be applied to fleas an Leos also IMO.

Department SOP should mandate at the very least all I mentioned.

Now this is warrant service or felony arrest I refer to. An active shooter incident should never last long enough for swat to even get the call.... First responders are provided the tools an skills to not Columbine such events ever again.

One mistake like these wrong address raids is reason IMO to fire every damn person involved an the department leadership that allows such a haphazard operating environment to exist....

And how will that be proved, unless their identities are revealed which I'm betting they will resist and probably, courts will uphold.

After all, why else do these (mostly) COWARDLY, Rambo-like-wannabe, GOONS, wear masks?

All other LEO's go about their duties easily recognizable, so what gives these thugs special dispensation, other than to protect them when things go south, which happen more often than not?
