You're right that the executive, as a matter of history, has chosen which laws to focus upon, THIS law will be a matter of litigation, which historically I BELIEVE, the Administration is bound by oath to defend.

Being a Naturally Curious Guy, I just re-read Article II of the Constitution of the United States . . . to see if my memory of the thing had faded.
Lo and behold, I did not read of this power that Obama has claimed for himself anywhere in Article II.

Unless our national attitude changes fast I agree 100% with what you say. A blatant Gay Congressman lead this nation in passing bailouts of which we can not afford in several generations. Thus a curse upon our economy has resulted. I believe our nation is in fact under judgment this very moment. Our elected leaders are a direct reflection of the corruption and will of We The People as a nation. That is not too say all persons are like this or chose this for our nation.
As a nation we have abandoned GOD {not all individuals have done so}. We've allowed a small minority of lawyers to toss GOD out of public venues including our schools which are now filled with violence, disrespect, and the gay agenda being openly taught. Abortion is common place and in many places a 16 year old girl can get an abortion without parental knowledge free by the state. Persons with gay agendas now are wnating access to pur kids even at grade school.
Really it would not take impeachment to end this. Secret Service can arrest POTUS for violations of law or an attempt to overthrow from power or office the United States Government or any three branches thereof. POTUS is not exempt from such prosecution in civilian court nor should POTUS ever be.
The lawsuits should start coming in against Pastors, Priests, Deacons who refuse to marry gays in a church.
Where are the Republicans with this announcement that the DOJ, President have both concurred that they will not enfore a Federal Supreme Court ruling, law?
So, if Obama gets away with this, what is preventing them from thumbing their nose at other SC ruling.

This has been clear since the administration ignored the ruling on Obamacare. This administration does not believe in the rule of law. They will do whatever they can. I just hope they leave without violence.
A case could be made that he just committed an impeachable offense:
From Article II, Section I - Obama had to swear the following:
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
And from Article VI, Clauses II and III:
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
Article VI gives Obama NO LEEWAY to pick and choose which laws to support and defend. He is bound BY LAW to defend the Constitution and ALL laws made in pursuance thereof.
Unless and until DOMA is repealed or declared unconstitutional, IT IS THE LAW OF THE LAND ...
Section 2.
The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;—to all cases affecting ambassadors, other public ministers and consuls;—to all cases of admiralty and maritime jurisdiction;—to controversies to which the United States shall be a party;—to controversies between two or more states;—between a state and citizens of another state;—between citizens of different states;—between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.
Article III, Constitution regarding SC:
In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be party, the Supreme Court shall have original jurisdiction. In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.
How does this not over-rule the President and the DOJ?
Like I said, the SC is for the balance of power, to keep it in check at all levels.
What if the President and DOJ said “guns are banned”...and we will start seizure of guns. Would the SC not be able to over-rule the Pres because of our constitutional right to bear arms?
Of course Gates is going after retiree health care because he needs to free up millions for the armed forces gay health care costs. Now that tea partiers can see how tens of millions of tax dollars will be spent on gay health care will someone please call Congress and tell them DO NOT change the UCMJ laws against gay acts on military bases! Before DADT can be fully repealed, the UCMJ must change or gays can still be prosecuted. I am tired of whistling in the wind it is getting lonely. Thanks, vented feel no better but vented. And dear God will you please make Gates retire before he destroys our military. Gates makes me miss Rummy!
Who cares about long term strategy? He doesn’t and had said as much. The goal is as much destruction as possible in ONE term. Hell, he probably won’t be able to even get ON the ballot in 2012 in some states; so he may as well go for broke.
