Agent Terry's murder: 3 suspects arrested will not be charged

TUCSON (KGUN9-TV) – Nine On Your Side has learned three of the four suspects arrested in the shootout that killed U.S. Border Patrol Agent Brian Terry will not be charged with his murder. In fact, all three suspects could be freed and deported sometime this week.

The FBI suspected bandits shot and killed Terry on the night of December 14th. Agents immediately arrested four suspects. But two weeks after Terry's killing, KGUN9 News learned the FBI had yet to charge them with murder.

The Federal Public Defender's office and private defense Attorney Leslie Bowman then sounded off by telling Nine On Your Side if the FBI had evidence it would have pinned murder charges on all four suspects.

"They rarely wait," said Bowman at the time. "They generally charge it from the beginning of the case."

On January 5th, the U.S. Marshal's in Tucson then reported a total of six suspects had been arrested in Terry's murder probe.

But the FBI denied the claim and confirmed to KGUN9 News it only knew of four suspects.

Then on January 13th, the U.S. Attorney's office indicted the four suspects but only on immigration charges for illegal re-entry after deportation. The felony charge carries a prison sentence between six months to two years.

Now, exactly two months after Terry's murder, Nine On Your Side has learned through sources close to the case, three of the suspects will plead guilty to lesser misdemeanor charges and are expected to be released and deported within the next several days.

That leaves one suspect in custody. The Federal Public Defenders office tells Nine On Your Side its yet to receive any type of formal disclosure or word from the U.S. Attorney's office clearing its client of Terry's murder.

Therefore, as far as it knows, its client continues to only face illegal re-entry charges. This same suspect was gravely injured and had to be hospitalized after his arrest.

The Federal Public Defenders office also said it's unusual for the U.S. Attorney's office to take so long to charge a suspect with murder if it has forensic evidence.

Of course they won't be charged.....in lieu of having to NOT testify against ATF agents whom supplied the assault weapons semi-automatic rifles to them.

Not if the evidence shows that the ATF actually did supply the weapon used to commit this crime. Not to mention that this crime happened in a Federally Protected Drug Trafficking Zone.

There is something very strange going on here. They have yet to release the names/identities of those who were present at this murder. This tells me that their identities would be an embarrassment to either or both the US and Mexican governments. These people are being, in essence, released. Yet they were present and and in the process of committing a crime when a U.S. officer was murdered, which usually leads to charges of being an accomplice to murder, if not a straight charge of murder. And there is no reason to believe the officer’s death was a result of friendly fire. No one has been charged with the murder, yet we have several suspects, who we plan to set free, and a dead officer. The media isn’t doing a very good job of throwing light on this event, and the U.S. Attorney’s office and FBI are actively obstructing the truth. Remember, this is the same U.S. Attorney’s office who prosecuted an Arizona rancher for holding trespassing illegal aliens at gunpoint on his property. The whole story stinks.

Look up google links to ATF Project “Gunwalker” and all will become clear. These illegals were PROVIDED the arms used to kill Terry by the ATF itself!!! Therefore, murder charges would have brought the entirety of the ATF’s involvement to the public. Can’t have that, of course!!!

Thanks for the information. Sounds like we may have a federal prosecutor in the pay of the Mexican traffickers. There was a similar situation in Texas, where a corrupt US Attorney prosecuted two BP agents for wounding and capturing an illegal drug smugglers.

It's worse than that.

The ATF is doing this on purpose to expand it's power. Remember all those stories of US guns showing up in Mexico? This is it. The ATF is pushing those guns across the border so it can come back to DC and push for more power and control. With this Administrations full knowledge, or at least complicit in it.

If all true, it is clear they have adopted the successful J.Edgar Hoover “Bureau Growth Model” and, in this instance, put some cash in some “underpaid” pockets.
