26-state suit presses on after House repeal

AUSTIN (KXAN) - While the U.S. Houses repeal of the presidents health care reform, the Patient Protection and Affordable Care Act, earlier this month might have been largely a symbolic gesture, what is happening in the legal system could actually change the course of this law. Sunday on KXANs Session 11 program, Texas Attorney General Greg Abbott eluded to a possible federal ruling in favor of a 26-state lawsuit against the ACA, what many Republicans refer to as Obamacare.
We got a heads up on Friday that it looks like the federal judge may be issuing a ruling tomorrow (Monday) in the case, Abbott said.
While the U.S. Senate is expected to pass on ousting the law, President Obama has pledge to repeal that action if it does. However, the multi-state challenge, including Texas, will likely find itself in the U.S. Supreme Court with a 5-4 conservative leaning. That chance is only heightened with the possible decision from a federal judge in Florida on Monday.
Based on comments made by the judge before this time, we believe that the federal judge in our case is going to agree with the federal judge in Virginia, and that is that Obamacare is unconstitutional to the extent that it has the individual mandate imposing the requirement that all Americans go out and purchase health care insurance, Abbott added.

This is so funny — the first thing I saw in that article was “eluded” and I copied it out to post a comment, and saw that almost all the comments so far were about it. And funny comments too, much cleverer than mine would have been.
It looks like NC is set to join 26 other states to challenge ObamaCare. Dems harangued over the possibility but both NC legislative houses are GOP-controlled now.

The judge’s decision, whatever it maybe, Will be Unconstitutional!Article III Section II states SCOTUS shall be the court of original jurisdiction regarding cases involving states!

[The states involved in the Florida suit include: Alabama, Alaska, Arizona, Colorado, Florida, Georgia, Idaho, Indiana, Louisiana, Michigan, Mississippi, Nebraska, Nevada, Pennsylvania, South Carolina, North Dakota, South Dakota, Texas, Utah and Washington, joined Jan. 19 by Iowa, Ohio, Kansas, Maine, Wisconsin and Wyoming. Would you please make abundantly clear if or that the final eight states that you list as having joined Jan. 19 by have BOTH launched separate cases AND enjoined the previous (to Jan 19) sixteen? I am really growing weary of this kind of language. Im seeing it all the time. I dont keep up too much on this but I thought the Oklahoma action was to make for 27 states and whenever I see postings, without going to real keeping-track sites, this running-together language seems to keep going on.

Outstanding! I've been worried about NC so it's good to see them getting aboard this initiative to shoot the finger at the federales. I gather the recent election influenced this development in NC?
