[Illinois] Supreme Court: Emanuel on Chicago mayor ballot

Did anyone really doubt that the Chicago fix was in all along? The Illinois Supreme Court just announced a 5-2 decision to allow Rahm Emanuel on the ballot for the February 22 Chicago mayoral election. Earlier today, former IL Republican Gov. Jim Thompson and other members of the state GOP establishment came out in favor of giving the former Obama ballot access.

Yeah, I read the dissent. It's "cr*p". The decision noted that once you have achieved residency you continue to be a resident ~ and the other side came up with no evidence whatsoever that Rahm didn't intend to continue being a resident!

If it were not the case that you continued to have residency once you had achieved it then every time you ventured outside of Chicago that would start the clock running again ~ and you'd be a resident of nowhere.

They also ruled that it is consistent with Illinois statutory law and the court's practices that such laws be read together and that they achieve the same end ~ to wit, residency.

For a long time I was part of a system of regulation that had such time periods as "4 weeks", "28 days", "20 working days", and "1 month". This caused no end of problems at the limits as field managers would rule that a time-limit was lengthened by 1 to 3 days by 3 day holiday weekends, or that after 4 weeks, everything expired, or that a 31 day month wasn't 28 days so screw the customer.

We fixed those rules finally, but first I had to go through every rule and find every instance of the words "minute", "hour", "day", "week", "month", "quarter", "3 month", "semi-annual", "6 month", "annual" and "365" days ~ oh, yeah, and "12 month". Once we had those suckers in hand we could decide what expressions we wanted to use ~ and if legislation had forced us to use something less than useful.

Still, our position in all cases was that where a time limitation benefited a customer we'd use that, and the same for an extension. That way there'd be no basis for complaint by outsiders.

Worked like a charm ~ almost a totally invisible revision of the rules.

The Illinois court ruled that Illinois practice has been consistent with similar principles. They also noted that now is not the time for a change ~ such as recommended by the Appeals court.

Oh, yeah, the Supreme Court also slapped down that Webster's Dictionary definition with TWO different Illinois court decisions on the matter, and a statute.

Now, let me ask you, did you bother reading the decision?

Rahm declared himself non-resident, then amended his tax returns after he discovered he was running for mayor. It is not comparable.

He voluntarily forfeited his residency to not pay taxes, then paid back taxes, then claimed he never left.

mvpel, this thread is about the ILLINOIS SUPREME COURT. They just overruled the corrupt judges over on the Appeals Court.

I hope you didn't miss that part ~ whatever the Appeals Court said on the matter is NULL AND VOID, and that ain't no Freeper!

It's pretty clear that Rahmbo will be put in office regardless of any elections or rules..

True.

It would cost a LOT of Illinois tax-payer dollars to re-fix the election with a ‘second choice’ candidate, re-print all those ballots, and ‘re-cast’ all those votes.

Now they do not have to worry about receiving second-rate corruption from a last-minute ‘candidate’ who has not been thoroughly ‘vetted’ by the ‘right people’ and who might even end up NOT being able to be fully controlled while in office.

The Illinois Supreme Court has done the fiscally AND politically responsible thing, here...

Ok once again better of three evils, Chico, Fraud and Rahm. Who is the best? Who is the worst?

I'm not a big Daley fan but wish he would stay he cleaned up Bridgeport and he cleaned up the West Side. I can finally go to a Bulls or Blackhawks game without worrying about getting mugged or harassed by a bum.

Not if your name is Paul Vallas. Vallas narrowly lost the Democratic gubernatorial nomination to Blagojevich in 2002. Vallas took a job in Philadelphia, but his wife and children stayed in a house in the Chicago suburbs and he commuted home on weekends. When Vallas wanted to run again the board of elections and the courts ruled that he was ineligible to run for office.

Emanuel leased his house and moved away for twenty-one months, his wife and children live in D.C., but he’s a resident.

Interesting to read the actual court opinion.

Based on a Illinois case from 1867, you don’t have to reside somewhere, to “reside” somewhere.

You know, like the meaning of “is”.

How can we complain about a so-called “Court” allowing Rahm Emanuel to run for mayor, even though he is NOT a Chicage resident, when his boss, Hussein Obama, who does not even have a US Birth Certificate, is President? At least Rahm HAS a Birth Certificate!
