He should do the five and tell them to stuff the ten years’ probation. With a leash like that on him, he’ll be useless for a decade after his release on the three [it would seem that the sentences would run concurrently, since the convictions are based on a common transaction-so that would mean two extra on the three, and no one looking over his shoulder for the ten].

WHAT IS CLEMENCY?
The governor has the authority to grant clemency upon the written recommendation of a majority of the Board of Pardons and Paroles. Clemency includes full pardons, conditional pardons, pardons based on innocence, commutations of sentence, and emergency medical reprieves. In capital cases, the Board considers applications for commutation of sentence to life in prison and for a reprieve of execution. If the Board recommends clemency in a death penalty case, the governor may grant commutation or reprieve. The governor can also grant a one-time thirty-day reprieve of execution in these cases.

If what you say is true, then Delay can appeal and win.

You can’t be tried for a crime which wasn’t a crime when you did it.

Six grand juries turned the case down until Ronnie Earle tricked one into an indictment.

This conviction will eventually be overturned, and the only thing that will have been accomplished is the knee-capping of an effective Republican.

It seems you have also pointed out that he cannot grant a clemency without the majority of the board approving. That’s interesting. I thought all chief executives (governors) were able to grant pardons.

I guess it would depend on if the crime was federal or not though.

Texas state law.... and these two convictions are violations of Texas State Criminal statutes not Federal law. One charge against DeLay was a violation of Texas State Election Code but that was thrown out by the Judge.
