The Tax Bill Passed by the Senate is Unconstitutional

The Senate has committed a major blunder today. I mean besides the RINOs being stupid enough to go along with the Rats. They have passed a revenue bill that did not originate in the House.

Article 1, Section 7
All bills for raising Revenue shall originate in the House of Representatives;

Can it be any plainer? Is anyone planning on challenging the constitutionality of it?

There is no controlling legal authority at present, which is why gun control is so popular among Federalists, er, I mean Democrats.

From the golden EIB microphone I heard today that the government should make it illegal not to own a gun.

This way the 2nd amendment can be kept up front and used as the Constitution dictates.

If government can make it illegal not to purchase health insurance, they should be able to make it illegal not to purchase a gun.

For those financially challenged, government should make it mandatory for those of us who can afford it to pay for guns to redistribute to those who can not afford to buy their own.

It started in the House and was voted on and sent to the Senate.

I believe one Freeper noted this was voted on LAST WEEK in the House. BTW, whatever the Democrats jigger up if the President hasn't signed it by the time the new Congress convenes in January, I suppose either house could vote for a resolution "deeming" the earlier bills NOT PASSED (kind of a reversal of what the Democrats did with the Obamakkkare bill).

Hopefully lawsuits will be filed.

Congress can’t ignore the Constitution. If they can, we can, because they derive their power from the states and the people.

It is getting close to revolt time.

First thing Repubs should do is a short simple piece of legislation to end lame duck sessions. Being seated as soon as an election result is declared valid. This is not the 1790s and there’s no reason for lame duck sessions anymore.

it works like this:

The senate does it.

They send it to the house. The house will create their own bill and vote on it. It gets sent to conference.

THEN the house will vote on the conference bill, thus originating it in the House.

There are things to get worked up about, and then there are things not to get worked up about.

This is the latter.

These guys are in need of a good ass whoopin, and some ole fashioned tar and feathers, I would love to see reid in atar/feather outfit..then have them tyake that vote again, its time to move beyond civility in Congree, I want to see some Asian style kick their ass go on..

I think anybody could draft a budget and submit it to the H of R, whether they adopted all or in part, as long as the bill originated with an HR tag in Congress, it would be Constitutional.

a couple of things:

1. the tax cut extension bills did start in the house earlier this month. this is the senate version, an expanded version of what the House passed. Now the house has to pass this “compromise” bill, which is different than the bills passed by the house already.

2. it isn’t really a revenue raising bill. it is extending tax cuts that are already on the books. It is more of a revenue dropping bill.

I would think that such a clear violation of the constitution is breaking news .. well .. then again considering the history if this particular congress, maybe not.
