NAGPUR: A sexual offender and murderer was sentenced to death by a local court on Monday for sodomising and killing a 10-year-old boy in January 2008 and disposing of the body in a well. Anthony Arick Swamy Joseph, alias Anil, was also accused in two other murder cases in the past but was acquitted in both.
Principal district and sessions judge SB Shukre had convicted Joseph of murder last week. He pronounced the quantum of sentence on Monday. The death sentence is subject to the confirmation of the high court. A fine of Rs 10,000 was also imposed on Joseph.
While Joseph's free legal aid counsel Sanjay Jogewar had tried to argue that the crime does not fall in the 'rarest of rare' category, additional public prosecutor Jyoti Vajani had countered the view and demanded the death sentence, which was upheld. This is the second case in which Vajani has argued successfully for capital punishment for a sexual offender.
Apart from the death sentence, Joseph will undergo 10 years of rigorous imprisonment and have to pay and a fine of Rs 1,000 for unnatural sex. He was also sentenced three years of imprisonment for destroying evidence.
In his remarks, Shukre had stressed on the "helplessness of the innocent boy, the only son of his mother, who was beaten in 'a most barbaric fashion by the man who unexpectedly betrayed his trust'. The age of Joseph, who is in his thirties, is enough to attain sufficient maturity to discern good from evil and be aware of the desired conduct in the society," said Shukre.
"Joseph showed immense depravity of mind and perversity of conduct which made the entire crime an uncommon one," said Shukre. The judge underlined the fact that Joseph had 'silenced the voice of the boy permanently by killing him' after satisfying his lust. Shukre also took into account Joseph's previous crime record and the fact that he did not suffer from any psychological disorder.
The judge maintained that showing any leniency towards Joseph does not hold any promise of improvement in his conduct. "Given a second chance, Joseph may prove dangerous to the society," he said.
If he got a fair trial, I’m totally cool with this.

That showing leniency does not hold any hope for an improvement in his behaviour- in fact according to past experience leniency made him worse every time.

It is wrong of me to wonder, but I can’t help but think the outcome might have been different if he were a Hindu, not a Catholic.
(I’m assuming he’s Catholic based on his name, and knowing another Indian with the same family name who, like many from his state, is Catholic)
Okay, my favorite part of that murder sentence is the fine. When you’re looking to put the guy up the rope, even for India, a $220 fine is adding insult to injury. And then he’s getting ten years at hard labor and (heh) a $22 fine for the sodomy. Let’s call the three years for disposing of the body an afterthought.

Dhananjoy Chatterjee (August 14, 1965 in Kuludihi, West Bengal, India - August 14, 2004 at Alipore Central Jail in Calcutta, India) was a security guard who was executed by hanging for the murder (following a rape) of 14-year-old Hetal Parekh on March 5, 1990 at her apartment residence in Bhowanipur.
Chatterjee, whose mercy plea was rejected on August 4, was kept at Alipore for nearly 14 years. The execution was scheduled on June 25, but it was stayed after his family petitioned the Supreme Court of India, and filed a mercy plea with the then President Dr. APJ Abdul Kalam. The family refused to either attend the execution or claim his body; it was later cremated.
The date of Chatterjee’s execution was fixed at a high-level meeting at the office of Jail Minister Biswanath Choudhury. This was the first hanging at Alipore since 1993, when murder convicts, Kartik Sil and Sukumar Burman, were hanged. It was the first execution in India since 1995.

What difference does it make what religion the pedophile was?
The Civil Justice System of India is based on secular principles of jurisprudence and is not some Hindu theological bastion.
Actually, rather speedy for Indian justice.
I'm more than a bit comforted by James C. Bennett's post of the resolution of a similar case of sodomy, pedophilia and murder.
I also fully agree with GeronL's take. (Although I do admire the Indian's 10 years hard time and fine, nice touch!)
