Martinez faces tough road ahead for repeal of driver’s licenses ( illegals in NM )
The New Mexico Independent ^ | 11/10/10 | Trip Jennings

Republican Gov.-elect Susana Martinez promised repeatedly during this year’s election to try to repeal a law allowing illegal immigrants to get New Mexico drivers licenses and to revoke thousands of already-issued documents. But interviews with state lawmakers this week make clear that undoing the law isn’t a sure thing when the New Mexico Legislature convenes in Santa Fe in January for one of the toughest sessions in recent memory.

For one, it’s unclear whether enough state lawmakers support the repeal effort to push it through both chambers in the Legislature, which Democrats still control despite losing eight seats in the House of Representatives during last week’s election.

Then there’s the potential for New Mexico’s budgetary problems to crowd out other large, controversial measures ...

...

About 10 states had similar laws on the books when New Mexico passed its drivers’ license law in 2003. But since then that number has dwindled to only three – New Mexico, Washington and Utah...

Currently around 80,000 foreign nationals have New Mexico driver’s licenses, but not all are illegal immigrants, making it difficult to determine the exact number of illegal immigrants with state driver’s licenses

How is it consitutional for New Mexico to legally recognize illegal immigrants? Doesn’t that violate the supremacy clause as Arizona is accused of doing?

An issue needs to be made about the lack of patriotism and the support for criminal activity those Dem pols are showing by resisting repeal of this ridiculous law. Their corruption is astoundingly open.

Simply change the renewal laws. Require US birth certificate, naturalization papers, green card, proof of residency etc, Check out NJ license application requirements. Drivers lic is how the 9/11 terrorists established bank accounts after their VISA’s expired.

The problem is, which is more dangerous, having uninsured unlicensed drivers, or licensed, insured illegal aliens?

And there is the third possibility - licensed, uninsured drivers. Don’t know about NM, but in Texas it’s not unhea5rd of for people to get insurance just long enough every year to renew their car/driver’s license and then drop their coverage.

In Oregon, we issued driver’s licenses to illegals, so that they could get the required automobile insurance, dontcha know.

Then, we were considered a National Security Risk because mules brought illegals from all over the country to get driver’s licenses, and then went back to their states with “documents”.

Thankfully, the Legislature was shamed into doing the right thing, and outlawing that mess.

Maybe some other states should do the same thing.

OT, but did you know that the word “dontcha” is in google’s spellcheck? I mispelled it the first time. lol

Constitutional law doesn't permit retroactive laws. Does this not roadblock the revoking of thousands of already-issued documents as well as overturns against gay marriages or is it a different state's rights deal?

The real problem is illegal aliens.

Hate to be blunt but - your ignorance is showing.

Illegals sign up for insurance and the never pay the premiums letting it expire. Since they can't be tracked because they are using a fake name they don't get caught till they kill or maim someone driving. Then, they may get deported and/or thrown in jail for a time. Giving them licenses DOES NOT guarantee they will carry insurance.

In NM you just have to say you have insurance - no piece of paper required.

The vehicle registration says something like owner affirms financial responsibility.

I hope Martinez proposes it to the state legislature, and let them hang themselves.

The only ones that want licenses for illegals are all the lib rates in Santa Fe and Albuquerque. They know that is the only way they will have some power. Take their ‘base’ away, and they are nothing.

I know one thing for sure Representative Miguel P. Garcia - (D) will not support repeal. Even other Hispanic (D) Representatives acknowledge that he is racists.
