Supreme Court Ruling Keeps Ban on Gays From Openly Serving in the Military

The Supreme Court ruled Friday that a controversial law prohibiting homosexuals from openly serving in the armed forces can remain in place while the government appeals a federal judge's decision striking down the Don't Ask, Don't Tell Act.

A gay rights group asked the high court to overturn a stay order from the Ninth Circuit U.S. Court of Appeals keeping the law in effect while that court reviews the case. The petition from the Log Cabin Republicans was presented to Justice Anthony Kennedy who is responsible for handling emergency requests out of the Ninth Circuit.

Kennedy's order simply said, "the application to vacate the stay entered by the United States Court of Appeals for the Ninth Circuit on November 1, 2010, presented to Justice Kennedy and by him referred to the Court is denied." The order also noted that Justice Elena Kagan, who until this summer was Solicitor General, didn't take part in the case.

If the liberals couldn’t get 4 votes to grant cert of this interlocutory appeal (with Kagan either recusing herself or not participating for some other reason), then it’s a pretty safe bet thay Kennedy voting against granting cert.

The next State of the Union address to Congress from Obama should be interesting to see what Obama has to stay to the Supreme court justices in the audience.

PRAY that Kennedy doesn’t retire while that Muslim Marxist is in Office.

Obama and the Dems may have helped tilt the Court rightward with that chastisement Obama gave during the State of the Union speech. Imagine being humiliated before a snickering Congress and hectored before tens of millions of your fellow citizens. That surely left its mark.

I dont know about the rest but Sam Alito will no longer go to another SOTU address while zer0 is _resident.

It is the Constitutional obligation of the Executive Branch to defend existing federal legislation—even if they don't want to.
Obama held off a bit on this one until his lawyers told him he had better do his duty or it will make his upcoming impeachment harder to prevent.

But the queer bars are full of them. And even the queers raised in the country are not held back from finding willing partners.

It seems to me that the likelihood of breaking a fingernail, standing a watch alone all night, having to sweat, schlep a heavy pack and risk their lives would definitely not be high on their agenda of desirable activities.
