FAIRBANKS -- A judge ruled today that the Fairbanks North Star Borough must release personnel records of Senate candidate Joe Miller.
In an unusual Saturday hearing, retired Superior Court Judge Winston Burbank ruled that the public's right to know about candidates outweighed Miller's right to privacy.
Burbank ordered no release until at least Tuesday, however, to allow Miller to appeal the decision to the Alaska Supreme Court. Some of the documents will be redacted, he said.
The case was brought by a group of Alaska news media organizations, who have been trying since summer to see borough documents concerning Miller's employment as a part-time borough attorney.
Miller, the Republican nominee, fought the release, arguing that any release of personnel records violated his privacy rights
Among the documents being sought are details of his resignation from the job last year, and any disciplinary actions taken against him while employed. Separate lawsuits were brought by the Alaska Dispatch and Fairbanks Daily News-Miner. The Daily News and Associated Press joined, and the suits were combined. Among the arguments for release was that the state Supreme Court, in earlier cases, has ruled that candidates for office expose their private lives to public scrutiny.

Yes , since no other judge would touch this stink bomb , the resorted to a retired judge who was appointed by her daddy . The smell is getting stronger by the hour .

Now that this judge has ruled that Miller "must" show his records, is there a judge or the same "retired" judge, that will rule that Bowrama "must" show his birth certificate and other pertinent records? This ruling could very well work in our favor.....

I'll tell you what - there better be a law on the books in Alaska stating that the public has a right to know private stuff about candidates, because, otherwise, this is just another example of a judge who has forgotten that it is his job and duty to apply the LAW, not whatever whimsical fantasy he has making his leg tingle. I'm sick of these judges pulling policy out of their rear ends and acting as if the public needs to treat it like the Word of God. If it ain't in the law, then it is none of the judge's damn business.

Remember that the "Trooper firing" investigation was headed by a guy who just happened to be the head of the Obama campaign in Alaska.

Retired/Senior judges tend to sit on less complex, less time-consuming cases. And this judge doesn’t seem to have spent that much time coming to this ruling (yes, they can make rulings ... then it’s off to the appellate level).
Funny thing, it’s the exact opposite of reasoning of the judge in the Lakin court martial case who said Lakin couldn’t have the discovery he wants because it could be embarrassing to the POTUS.
I can see this being overturned because personnel records, like medical records, have become sacrosanct.
