This is almost of bad as a loss, since the current policy is detrimental to the minor parties.
As things stand, voters who select the same candidate on two different lines on the paper ballots used by the new voting machine system will see their vote counted for the first party that appears on the ballot.
That is, of course, very bad for the minor parties. The WFP appears in Row E; the Conservative Party is on Row D (ironically, a spot the WFP has been trying to usurp for years now).
If the WFP fails to hit that 50,000 mark in the governors race, it will lose its official status and, more importantly, its ballot status. Ditto for the Conservative Party, which already has enough to worry about, given the implosion of its standard-bearer, Republican gubernatorial candidate Carl Paladino.

As a former New Yorker I know the NY rules. What we are talking about here is double voting, voting for two names for the same office - in most places always two different people, in NY, possibly, the same name twice. This is possible both with the new scanned ballots and with old fashioned (check the box) type voting, but not with the old mechanical voting machines, which made it impossible.
In most states the vote would not be counted for either candidate, this system counts votes for the candidate, and assigns it to the first place on the ballot it appears, which hurts 3rd parties co-nominating a candidate, but at least preserves the citizen’s vote. Short of a system of validating the ballot before it is cast, which we have in Florida, this seems better than simply throwing out the vote.
Of course it also helps if your supporters aren’t i;;iterate idiots!

This guy has no idea of the surprise he will get. People will vote for Paladino on the Conservative line in huge numbers.
I always vote on the conservative party line for candidates who are there and on the GOP line as well. In Gnu Yak I want to see this party RISE, also, Hey Zogby, How come you do not list the Conservative Party in your surveys? Afraid of the results?
It is ironic, that this over vote problem, or double vote, could NOT happen on the old lever machines. Only on paper ballots.
Even during the LEVER years, many paper ballots were used: emergency, affadavit, military and absentee. Over voting or double voting often happened on paper ballots then, too.
But there is something NOT mentioned here, or if it has been mentioned, I want to point it out again.
Using Paladino as the example, if you vote for him on multiple parties, the credit will go to the first party on the ballot. If you vote Republican/Taxpayer, Republican gets the vote.
However, the SCANNER will DEFINITELY, inform you, on its screen, of the over vote, and you will be given a chance to correct this on a NEW, unmarked ballot. You can get the new ballot, and mark Paladino’s name only once, as you should have done originally. BUT, the scanner will also say, you can leave the ballot as is, and if you okay this, the vote (say Republican/Conservative) goes to Republican.
Now suppose someone, presumably by error, votes Paladino Republican and Cuomo Democrat? The scanner will inform the voter of the error and he can get a new ballot. However, if he chooses to keep his vote as is, the scanner WILL accept it, and he will lose his vote for Governor.

In New York, where there is NOT a separate Conservative candidate for Governor, just Paladino, the Republican, running on the Conservative line too, why, then, would it be necessary for Zogby or any pollster to include ANY party other than Republican and Democrat?

I am sure that year all polls for Senator included the candidate of the Conservative Party.
My state doesn’t throw out good ballots.

Where are you hearing this? The Board of Elections says that if the voter votes for the same candidate on more than one line, the scanner WILL notify the voter of the over vote and the voter can get a new ballot.
Only if the voter rejects the new ballot and tells the computer to keep his vote as is, will the vote go to the first place it appears.
The filled out ballot is placed into the scanning machine. The ballot is scanned, and if the scanner finds that there has been an over vote or double vote, the voter is DEFINITELY told this. An error message appears on the screen. So, the VOTER IS notified of the error and given the chance to fix it!

I got this from the OP and post #5. As I said, I’m a former New Yorker, now in Florida, depending on the thread for the current NY situation.
This is what I have now heard:
Someone who over votes, that is voting for two different candidates, is given the opportunity to correct the error. An error message will appear on the scanner screen and the voter is given the opporunity to fill out a new ballot.
But according to the WFP, someone who double votes, that is votes for the SAME candidate more than once, is NOT notified and the vote goes to the first party. No error message appears on the scanner screen.
Until this is resolved, at the very least there should be signs by the privacy booth, explaining BOTH scenarios, over vote and double vote, and telling the voter DO NOT DO IT!
