Health-Care Law Ruled Constitutional by U.S. Judge

A U.S. judge upheld the constitutionality of the health-care overhaul President Barack Obama signed in March, rejecting an argument brought by a self- described Christian law center in the first legal victory for the new law.

U.S. District Judge George Caram Steeh in Detroit today denied the Thomas More Law Center’s request for an injunction against the law and said the group failed to prove the statute is unconstitutional under the Commerce Clause.

“The minimum coverage provision, which addresses economic decisions regarding health-care services that everyone eventually, and inevitably, will need, is a reasonable means of effectuating Congress’s goal,” Steeh wrote.

They’ve already lost the “constitutional test” by making selected exceptions within the law. McDonald’s has some sort of exception already. Will Burger King receive the same exception?

Take it to SCOTUS they’ll overturn the Detroit Dweeb

The SCOTUS can no longer be depended on to rule on constitutionality. Barring that, look at how long it took for McCain/Feingold to wind its way through the system before it was presented to the SCOTUS. This is a very bad sign. Waiting for Virginia's ruling (Landmark is involved in it (Mark Levin)

Can one of the brilliant freepers here explain what happens when judges in different areas rule in complete opposition to one another?

How’d it end up in Detroit?

I asked myself the same question. I discovered Thomas More Law Center is located in Ann Arbor Michigan. This fruitcake judge's turf apparently.

IMO, he’s stepped WAY beyond his the turf of his position.

He shouldn’t be meddling and opining on legislative/
political/policy issues .. ONLY Constitutional ones.

I don’t know what it takes to convince people that the judiciary is very corrupt.

It is corrupt very graphically. Corrupted in the sense that personal agenda, i.e. bigotry, prevails over the letter or obvious intent of the law, as it was legislated in the first place. The immigration issue case in point - illegals are illegal. Power corrupts.

But how to straighten it out? Most federal politicians are lawyers, i.e. aspiring judges, and would are very reluctant to face down members of their own profession - the equivalent of the RC heirarchy during the Reformation.

The fundamental basis of the legal venue is to have a cross section of citizens, the jury, do the rulings. An egalitarian society can do no better than that. But don't tell that to any judge or lawyer, or politician, they know best - thus we have the morass we are in today in the US.

If Medicare and (ugh, thanks for nothing) RomneyCare were left to stand, I’m not sure you could get anything other than a conservative court to declare ObamaCare unconstitutional.

The camel’s nose was already in the tent, folks.

The only way we’ll get out of ObamaCare is through legislation. That makes this year and 2012 important.

It's not only corrupt, it's perverse. I'm sure there are a few good ones, but on the whole I've come to regard judges as two legged cockroaches, worthy of no more respect than the six legged ones.

We can bring a suit regarding Obama’s eligibility, wherein the 2 that he nominated have to recuse themselves and the others - if they have any sense at all - can finally order discovery whereby it will be found that Obama is not eligible, the electoral vote was never legally certified and so there was no lawful inauguration, and anything that Obama did using the presidential powers is nullified.

Wow. Do you think the fact that Muslims are exempt made it a little bit easier for this Michigan judge who is president of the Arab American Bar Association to go along with this unconstitutional law that discriminates on the basis of religion - favoring Islam over others?

Good first step to Sharia maybe, huh?

no way in hell it is overturned. useful exercise nonetheless as it provides an opportunity for our side to make its case in the media if the talking heads discuss it and if we get anything other than a token RINO on those shows
