About the Presidential Power to Pardon (Would Hussein DARE to try and Pardon Illegals?)
Jurist Law at Pitt ^

Posted on 10/04/2010 6:38:50 PM PDT by Recovering_Democrat

The President's pardon power is established under the United States Constitution, Article II, Section 2:

The President ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment...

But how, if at all, should such a power be limited? A proposal introduced by Connecticut's Roger Sherman to make Presidential pardons subject to the consent of the Senate was considered but quickly rejected by the Convention (the Senate was deemed to be powerful enough already). So was Luther Martin's suggestion of confining pardons to convicted persons only...

With the single exception of impeachment, then, the pardon power emerged from Philadelphia as exclusive, broad, and unfettered by the regular checks and balances of the governmental structure.

He can pardon them from PAST crimes, but not for future ones. By being here illegally, they commit a crime every moment of every day.

The lawyers would eat this one up - if only because of the time to be billed for extravagant court cases.

Well, so far he’s been waving his magic wand and getting his way about just about everything he “wanted” so far. He’s had the majority to do it. He does as he pleases. No matter who it chaps, it seems. If anyone bucks him, he plays the race card, or the lapdog media plays the race card. - What a revoltin’ development this is!

Those that get a “pardon” from Obama may have to pay the Piper later on...Obama failed to qualify to even be President.

In effect he has no standing to pardon anyone.

Could a pardon be a blanket pardon, or would it have to name each person?

Of course hussein will try it. He's only doing one term anyway.

Maybe he can pardon an illegal alien but he can’t make them legal.

It would appear he can but his actions would make him subject to impeachment.

Wouldn’t they have to be convicted in a court of law first? They are innocent until proven guilty...you can’t pardon an innocent person.

But how, if at all, should such a power be limited?

It's already limited by the Constitution itself.

When they said - The President ... shall have power to grant reprieves and pardons for offenses against the United States, they meant offenses against they areas of jurisdiction held by the federal government, NOT the entire country.

As another poster pointed out, 'pardons' cannot confer citizenship....but then again, neither does the ability to make a uniform rule of naturalization.

Try it before the elections?

Could they be that stupid?

Try it after the elections?

If the elections go as we think, he doesn’t stand a snowball’s chance.

This is ludicrous, and even The Messiah can't wave his magic wand and expect that Americans will accept it.

Watch the rebellion begin in earnest.

Nope, a pardon is a get-out-of-indictment-free card. The idea here I believe is that Zero might pardon them for being in the country illegally, perhaps giving them immunity from deportation.

But not from getting shot on sight.
