Rockhampton man shot in neck by householder as he attempted to break into house using an axe(Au)

A MAN remains in a critical condition after being shot in the neck while trying to chop down a neighbour's door with an axe in Rockhampton last night.

The 39-year-old was airlifted to Brisbane from Rockhampton this morning after he was found unconscious at the address in Bolsover Street.

Police have interviewed a number of witnesses to the incident just after 7pm yesterday.

A number of people are believed to live at the address but the “person of interest” fled shortly after the shooting and remains at large.

Police are also yet to recover the gun.

The two people are believed to be known to each other and had been involved in a long-running neighbourhood dispute.

It is also illegal under most circumstances which could explain why the shooter fled the scene.

My sixth sense tells me there is more to this story so stay tuned!

No, it's not.

Australian law allows the use of deadly force in self defence in any case where a person has reasonable grounds to feel they or another person are at risk of death or serious injury.

Under normal circumstances, somebody using an axe to force their way into your home would definitely qualify.

Some reports suggest there's more to this case that might make some difference (the two men seem to have known each other prior to events last night) but most of the time what has been described would definitely be a case of justified self defence under Australian law.
