Court won’t force state to defend Prop. 8

A California court has refused to order Gov. Arnold Schwarzenegger and Attorney General Jerry Brown to appeal a ruling that overturned the state’s gay marriage ban, according to an Associated Press report.

The 3rd District Court of Appeal in Sacramento on Wednesday denied a conservative legal group’s request to force the officials to defend Proposition 8 in court.

The court did not give a reason why it turned down the request by the Pacific Justice Institute.

Basically, the courts have said that the people can’t amend their constitution to prevent a behavior that has been illegal in most cases, and has never been permitted in the history of the republic and most of world history.

If the people don’t petition for redress of grievance on this, and petition to the Supreme Court, as part of their government, then what other avenue remains except taking the law into their own hands?

And our current politicians federal/state judges seem to be as blind to the possible consequences as King George was back in 1776.

Politically speaking, this is probably a better result just prior to November than a weak sister defense put on by the State of California. This result will get voters mad.

Arizona Governor Jan Brewer is using private counsel to fight for SB1070 rather than allow Democrat Attorney General Terry Goddard spoil the case.

California is the ultimate example of the ruling class vs. the country class. The people follow all the laws and their state constitution and amend it as it prescribes. Then the ruling class takes it upon itself to simply ignore it because THEY know better than the country class.
