The Senate has voted to confirm Elena Kagan.
It is this kind of thing that makes prospects of anything like a real turn around in November an iffy proposition. This woman is NOT qualified for this position. She has demonstrated a lack of regard for our Constitution and displays the typical leftist’s penchant for treating political fad and current caprice as a sound basis for law. The Republicans who voted for this woman, who declined to block this confirmation, who think it is OK to appoint an anti-American, anti-Constitution leftist appartchik to the highest court of the land and who consistently roll over for any outrageous ruling made by that court are as much a part of the problem as the enemy leftists that currently control our government.
Every day now the stakes get higher for this coming election. Not only must Republicans win at least one house at the federal level but they must take action to halt the headlong rush to bankruptcy and the destruction of the Republic. And if they take the White House and control the legislature after 2012 they must act to repeal the idiocy passed by this current regime and to reset the course of this nation. If this does not happen there will be, I fear, dire consequences because a significant portion of the citizenry is simply fed up and not likely to take any more of the insane leftist agenda that has as its aim the destruction of this nation.

We really need to make sure we elminiate the Dem majority in the Senate come November. There is too much at stake. I don’t know about you, but I can’t take much more of this Dem controlled house/senate/White House....it is aging me to much too fast.

Not likely but, a Supreme Court Justice may be impeached by the House of Representatives and removed from office if convicted in a Senate trial, but only for the same types of offenses that would trigger impeachment proceedings for any other government official under Articles I and II of the Constitution.
Article III, Section 1 states that judges of Article III courts shall hold their offices "during good behavior." "The phrase "good behavior" has been interpreted by the courts to equate to the same level of seriousness 'high crimes and misdemeanors" encompasses.
In addition, any federal judge may prosecuted in the criminal courts for criminal activity. If found guilty of a crime in a federal district court, the justice would face the same type of sentencing any other criminal defendant would. The district court could not remove him/her from the Bench. However, any justice found guilty in the criminal courts of any felony would certainly be impeached and, if found guilty, removed from office.
