Testimony Sought of “Custodian of Records” AND Production of all records relating to President
Decision to be made by Army Major General
Washington, D.C., July 29, 2010. The Army doctor who is facing a court martial for refusing to obey orders, including a deployment order for his second tour of duty in Afghanistan, has formally requested his Commanding General approve a deposition in Hawaii of the records-keeper of the State Department of Health—and the production of all of their records concerning Barack Obama.
The records Lakin seeks have been the subject of intense interest ever since the closing days of the 2008 presidential campaign when a document appeared on the internet purporting to be a certification that Hawaii’s Dept. of Health had records showing he had been born in Honolulu. Since then, Dr. Chiyome Fukino the head of that agency has made public statements on the subject, but has refused all requests for copies of the actual records in the Department’s custody. Recently, a former Hawaii elections clerk has come forward saying that he was told that the Department’s records showed Obama was NOT born in Hawaii.
The United States Constitution requires that a person be a “natural born citizen” to be elected to the presidency. If Mr. Obama was not born in Honolulu as he has claimed, then he is unlikely to be a “natural born citizen”. An examination of the records kept by the Hawaii Dept. of Health are an essential first step in ascertaining Mr. Obama’s constitutional eligibility to hold the office to which he was elected in 2008.
While no civil litigant has obtained discovery of these records, and all the civil lawsuits seeking those records have been dismissed on procedural grounds, Lakin’s case is different because he is the subject of criminal prosecution, and upon conviction stands in jeopardy of being sentenced to years at hard labor in the penitentiary.
Lakin’s request was submitted by his counsel to the Commanding General of the Military District of Washington, Major General Karl R. Horst, under Rule 702(b) of the Rules for Courts-Martial, which provides that “A convening authority who has the charges for disposition or, after referral, the convening authority or the military judge may order that a deposition be taken on request of a party.”
Lakin’s civilian attorney has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense to LTC Lakin. The NBC clause does exclude Obama from the presidency in that there is no evidence he is a natural born citizen. Period.

In the wording of 1790 , THAT MAY BE meant INCLUDING.
The founding fathers STATEMENT IN 2010 TERM. ( CHILDREN OF CITIZENS SHALL BE CONSIDERED NATURAL BORN ,INCLUDING THOSE BORN OVERSEAS). obama has admitted to having dual loyalty at birth(fight the smears site), and it’s obama status at birth that counts under Article 2. Under Article 2 of the Constitution you can’t be a Natural Born citizen and have dual citizenship, as obama did at birth by his own admission.
If Julius Ceaser had half of his men questioning his birth origins and legal authority, and he had a long-form certificate proving his credentials, he would produce it in a heartbeat to quell the ranks.
Obama is no different. He is not producing a long-form because it would disqualify him. Instead, he hides it as more peons come to believe he is in fact an illigitimate fraud. Ending it is in his interest, but he can't.
This “birther” thing just won’t die and its zombie-like nature is starting to annoy an awful lot of Americans. And that is dangerous.
Whether he is or he isn’t, JUST SHOW US THE DAMN DOCUMENTS and end this!
Every lawsuit gets shot down as “frivolous” or the plaintiff has “no standing” or some damn excuse and we’re sick of it. Not one single judge has shown the balls to let this thing be heard on its merits and that is infuriating.
Does anybody think Lt. Col. Lakin will get anywhere with his request? Of course not! His commanding general won’t have the stones to live up to his oath, just like all the rest, and we all know it.
This thing is not going to end well, but it certainly will end.
The liberals who opposed the war, thought it illegal, would have prayed for a long jail term for Bush, etc., with rare exception, are hardly the same people who were called upon to deploy to Iraq and/or Afghanistan. The former would never put on the uniform, and most would not show it respect.
As I recall, Lakin did a couple of tours over there. That prior service doesn’t exempt him from military discipline for refusing to go this time, as he knew full well when he took this stand.
Could you picture a person who calls everyone idiots be the person who would be able to cover your back on the battle field, I would be very, VERY uncomfortable if he was to cover me, wouldn't you???
But questioning Obama's authority is not what Lakin was charged with. Obama could be unmasked as a fraud and removed tomorrow, and Lakin would still be guilty of missing movement and disobeying the orders of his CO. So it's not a difficult question for the Army at all. It's a matter of good order and discipline.
An Albatross hung on Obamas neck for the next two years, as Lakin files law suit after law suit for damages.
All of which will be denied for lack of standing, so why will these be any more of an issue than any of the other Birther suits?
At the same time, Obama, like a King, refusing to show his long form. On its face, That is Kenyan-butt-Ugly.
Obama will due what he will due. And all the Lakins in the world going down in self-inflicted flames will not change that.

There's a simpler explanation. The birther issue is politically divisive for conservatives. By doing nothing, Obama keeps his opponents divided. Why would he help unite his political enemies?

The US does not recognize the demands made by a foreign country upon its citizens. If the person chooses to live as a US citizen, then no other country can force their citizenship upon him.
My sister was born in Germany of US parents. If Germany tried to enforce a claim of citizenship upon her, the US would tell them to take a hike.

I’ve read ample documents written in the 1700s and earl 1800s...English is not your strong suit.
I was driving down rout 78 in Hamburg PA, and I saw the “Wheres The BC” sign. It is being viewed by millions every week. All those who saw the sign will be treated with seeing a man go to jail for asking that same question. Oh yes, technically for disobeying orders. But we all know why, don't we?
Sometimes logic can help us avoid truth for a time. But Time will out truth eventually. And the truth is, Mr. Lakin has refused to accept orders from a man who has refused to show his birth documents. The American people are not going to be amused with Mr. Obama when they see Mr. Lakin being punished.
It is in Mr. Obamas interest to show the documents, unless they show he is not qualified. The time for games with the issue have come and gone. We are at ground zero now, with a man set to go to prison. Yet he still refuses to show. For the average citizen, this will be disgusting.
The same applies to Obama's status as a US citizen, professor.
