Testimony Sought of “Custodian of Records” AND Production of all records relating to President
Decision to be made by Army Major General
Washington, D.C., July 29, 2010. The Army doctor who is facing a court martial for refusing to obey orders, including a deployment order for his second tour of duty in Afghanistan, has formally requested his Commanding General approve a deposition in Hawaii of the records-keeper of the State Department of Health—and the production of all of their records concerning Barack Obama.
The records Lakin seeks have been the subject of intense interest ever since the closing days of the 2008 presidential campaign when a document appeared on the internet purporting to be a certification that Hawaii’s Dept. of Health had records showing he had been born in Honolulu. Since then, Dr. Chiyome Fukino the head of that agency has made public statements on the subject, but has refused all requests for copies of the actual records in the Department’s custody. Recently, a former Hawaii elections clerk has come forward saying that he was told that the Department’s records showed Obama was NOT born in Hawaii.
The United States Constitution requires that a person be a “natural born citizen” to be elected to the presidency. If Mr. Obama was not born in Honolulu as he has claimed, then he is unlikely to be a “natural born citizen”. An examination of the records kept by the Hawaii Dept. of Health are an essential first step in ascertaining Mr. Obama’s constitutional eligibility to hold the office to which he was elected in 2008.
While no civil litigant has obtained discovery of these records, and all the civil lawsuits seeking those records have been dismissed on procedural grounds, Lakin’s case is different because he is the subject of criminal prosecution, and upon conviction stands in jeopardy of being sentenced to years at hard labor in the penitentiary.
Lakin’s request was submitted by his counsel to the Commanding General of the Military District of Washington, Major General Karl R. Horst, under Rule 702(b) of the Rules for Courts-Martial, which provides that “A convening authority who has the charges for disposition or, after referral, the convening authority or the military judge may order that a deposition be taken on request of a party.”
Lakin’s civilian attorney has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense to LTC Lakin. This going to get ugly beyond belief if Lakin goes to jail, and they must send him to jail as an example. A private with no pension will have a free “get out of Afghanistan ticket” if they dont.
If Obama is playing games and has a legitimate long form, he is going to be hated and despised for hiding it and allowing this man to go to jail. If he continues to hide it, the contempt for him will grow even faster.
We are almost at a point where its a “Lose - Lose” for Obama to keep hiding it.

And extending that, that no person born in the US, regardless of the citizenship of their parents, is amenable to citizenship claims by another country. So, a child born in the US, to German citizens, is a US citizen (natural born, to boot), and therefore has allegiance to the US. Must that person register for the US military draft, etc.?
Adding, that this quality pertains to naturalized citizens, just as much as it does to those who obtain citizenship other than by naturalization.

The birther issue is the distraction. Obama is merely signing the legislation that his "ilk" are crafting and passing...and the Dem congress are born and bred US radical leftists. It's the liberal agenda that is the problem! Much of the legislation that was proposed has been sitting on the shelf for decades...long before Obama even thought about politics.
Conservative majorities are the goal...birtherism is an impediment to achieving it.

Observing Birther antics is more of a hobby than a job.
The only ex-Marines I know are my oldest daughter and her husband, who agree with me about deploying.
And all the military I know are conservatives, as am I. Conservatives believe in keeping the military out of politics. If Lakin wanted to quit and then bring up a court case, I would only think he was wasting his time.
I don't find any of this going on to be funny.

And whose ass does Lakin give a rat about? Other than his own? I mean the man had a legal defense fund up and running long before any charges were filed. What is his real motivation in this? The good of the Army? The good of the country? Or the good of Lakin?

If in the USA, yes. If living in Germany and having shown no desire to live in the US, no.

The "birther" issue is in fact the core issue. Zero's hidden birth record will show what country he was born in and who his parents are. Both of which are determining factors in his legal "Natural Born Citizen" status. Zero will never of his own volition release his birth record because he knows it is legal evidence of his violation of the constitution. To say this is a distraction is to say that the constitution is just another piece of paper.
The truth is that Lakin never received an order from a man who refused to show his birth certificate. He refused to obey an order from his brigade commander and the officer next rung higher on his COs chain of command. He'll be tried and convicted for that.
The American people are not going to be amused with Mr. Obama when they see Mr. Lakin being punished.
Did the American people give a damn when Ehren Watada was court martialed? Or Yolanda Huet-Vaughan was separated from her children and sent to Leavenworth for a couple of years? Or Michael New or any of the other people who decided for themselves that they could decide what orders to follow and what not to? The overwhelming majority of the country is not going to care one way or the other that Lakin threw his career down the toilet.
For the average citizen, this will be disgusting.
The average citizen has never and will never hear of it. It's a blip in the evening news, maybe, in some places.

You are correct to ephasize the past tense. At birth, the Queen of England claimed him as a subject, even though he never did anything to benefit from his subjecthood, and then did nothing to retain in when he became an adult.
Why should we, who fought a war to free ourselves from the Tyrrany of English kings, condition our presidential eligibility based on the arbitrary claims of English kings?
