Conservative website among 3 sued over R-J copyrights (Free Republic sued AGAIN)

A conservative news-sharing website with plenty of experience in dealing with copyright issues has been sued for copyright infringement after Las Vegas Review-Journal stories allegedly were posted on its site.

Free Republic LLC, James C. Robinson and John Robinson, who are associated with the website www.freerepublic.com in Fresno, Calif., were sued in federal court in Las Vegas on Monday over the postings.

I suspect the LV R_J is currently writing up a biopic article on The SCO Group and CEO Darl McBride, and McBride gave them the idea to threaten to sue every website that ever linked to them for copyright infringement if every website on the internet doesn’t sign a licensing contract.

I also want to note that none of the Copyright notice notifications on that site, such as “Copyright © Stephens Media LLC 1997 - 2010” are links that describe what they consider fair use or distribution limitations. A member of the general public who wants to share the article has NO guidance from that website as to limitations of sharing. The only indication a general citizen has as to the paper’s opinion of what it limits in sharing is the links the paper provides to share the aritlce. In other words, they encourage article sharing.

This isn’t an attack on Free Republic as it is an attack on all citizens on the Internet who want to provide commentary on news.

When you click a facebook button it posts a link to the story, not the whole thing.

facebook links typically post an excerpt (not just a headline) and the poster can even include commentary or another text passage excerpt as “comment”. Also a photo can be displayed via facebook prompts.

It still encourages article sharing. Clicking that link doesn’t say “don’t post the text only the link”. How is average Joe Citizen supposed to know? Extortion, plain and simple.

I’d be more than happy to help out with the defense again. It’s been nearly 10 years but in my opinion, we were very successful last time ... despite having the deck stacked against us by a Clinton-appointed trial court judge. Since the last time, I’ve gained more experience in copyright litigation defense. It’s a different ballgame.

This should be easily proven. The mods are absolutely on top of everything including pulling and editing when copyright is involved.

Of course it’s a thinly veiled attempt to shut Free Republic down.

Posting link on Missouri side and hope individuals will post to their respective states/national boards. Hopefully it will give a boost to funds.

On a side note, I saw an article posted the other evening that the govt has shut blogs down for....you guessed it, copyright infringement. This is the path (for now) they are choosing to shut down free speech/1st amendment.

Thank you Jim, John, and Mods. You all do a terrific job; we’re grateful.

It still encourages your average Joe Citizen to share articles on the site and doesn’t specifically spell out limitations when they do share.

In other words, they encourage Joe Citizen to share articles then sue the places where the articles are shared.

How long until they start suing the Joe Citizens who do the sharing, not just the sites they post them to?

We’ll notify our lawyer that a suit is coming, but I have not seen it yet. Didn’t even receive a notice or a request. This article is the first I’ve seen of it.
