You could use the same reasoning to strike down defamation laws. It will be interesting to see what the Circuit Court of Appeals says about this.

I have to agree with the ruling. With that being said, he needs to pursued legally by every organization that fell for his fraud and he needs to be publicly ridiculed on the front page of every newspaper in the area where he lives.......

The judge's ruling clearly shows either willful bias, or ignorance of the law. “Freedom of speech” is known to have many legally recognized “exceptions”, yelling fire in a crowded theater being the canonical example. It doesn't trump speech used during the commission of a crime, inciting treason or insurrection, slander, misrepresentation, etc. Claiming “freedom of speech” without qualifying the nature of the speech, context. or harmed parties is what a first semester law student would do.

Given that he stole someone’s identity and used it to raise cash, forget the “Stolen Valour” charge- this is a simple case of fraud.

Instead of trying to prosecute cases on speech grounds why not go after someone based on fraud? It’s one thing to lie about yourself but it’s another when you do that to solicit money, which this guy had done.

A federal judge in Denver has ruled the Stolen Valor Act is "facially unconstitutional" because it violates free speech and dismissed the criminal case against Rick Strandlof, a man who lied about being an Iraq war veteran.

I didn't realize that fraud was guaranteed under the Constitution.

IMHO the US Attorney argued the wrong points.

The Stolen Valor law isn't about cheapening military awards and decorations. If they were most VFW and DAV halls would be empty.

They are about prevent fraud. Military service, particularly valorous service, rewards individuals with tangible results. The higher the award the more the rewards. Otherwise your liars would stop at being a discharged junior sergeant or junior officer.

Look at politicians of all strips that have lied about their service from a disabled Congressman who was disabled by his own weapons to people who have never served. Why?

The did it to fraudulently convince us that they were more qualified to hold office.

The article failed to mention what benefits the defendant had applied for based on his lies. That is was the US Attorney should have focused on - tangible fraud not an abstract concept. That would have made it much tougher for the Judge to issue his rulings.
