New federal regulations issued this week stipulate that the electronic health records--that all Americans are supposed to have by 2014 under the terms of the stimulus law that President Barack Obama signed last year--must record not only the traditional measures of height and weight, but also the Body Mass Index: a measure of obesity.
The obesity-rating regulation states that every American's electronic health record must: Calculate body mass index. Automatically calculate and display body mass index (BMI) based on a patients height and weight.
The law also requires that these electronic health records be available--with appropriate security measures--on a national exchange.

The EMR we use at work calculates BMI; I would think that they all do. The problem I have with this is that they will be required to be available NATIONALLY.

And instead of 17-year old kids trying to convince somebody to buy them a six-pack, we’ll see fatties hanging outside of supermarkets trying to convince some 17-year old to buy them a quart of ice cream. How the worm will have turned. But it will afford a great business opportunity for skinny unemployed teens to start personal shopping services.
A new Congress can defund the law and the agencies designed to implement it.

If they have your height and weight this just a computer calculation. No permission would be required to accomplish this.
body mass index is worthless -especially if you workout and have a good amount of muscle on you.
This is going to screw over alot of people who actually are quite fit.

I’m going to guess her BMI would not fit within the “recommended” level - but I’m sure they would just change it for her.
First of all - she works out and appears to be somewhat muscular.
Second of all - she has a natural “asset” that is working against her.

I see this being challenged in court by all sides. As pointed out, the BMI alone is worthless. The only way to tell if someone is “obese” without seeing them is by combining BMI with body fat measurement testing. Typically this is done by careful tape measuring, calipers or electrical impedance measuring.
Quite simply, the scenario goes like this: “Thanks, but no thanks, you are not going to measure me - period”. They can sit there with a stunned look on their face all they want.
Now the ball is back in their court - what will they do then? Nothing, thats what.
I see this BMI reporting REQUIREMENT being rather easily challenged and being defeated in court. As pointed out, even a lot of Liberals, Libertarians, Independents, fat Socialists etc are not going to stand for this more than likely.
Question Leftist authority. Push back against government control.

Oh, you are preaching to the choir. There is not one thing I like about Obamacare or the way it was passed. What I want to see is a much stronger push on the part of GOP leaders to repeal it. Right now the GOP is doing the usual; hand wringing and vague promises, sans any real charge—with teeth in it—to get the job done. They should be pulling a Churchill, and saying they’ll fight them now; they’ll fight them in 2011; they’ll fight them in 2012; they’ll fight as long and hard as it takes, but this thing WILL be repealed.
