In May of 2009, Elena Kagan, as US solicitor general, filed papers with the US Supreme Court encouraging it not to listen to arguments in a lawsuit against the Saudi Arabian government. The suit was filed by thousands of family members and victims of the 9/11 terror attacks on the US.

You know what,, i might be wrong, but i think this suit was also resisted down the line by the Bush administration. They also fought the Lockerbie families from attaching the assets of Lybia. Same again for iranian hostages and victims going after frozen Iranian assets.
Sadly, the US govt, Rep or Dem fights hard to keep deeply harmed citizens from suing foreigners.
Would that be because the US wouldn’t want to be vulnerable to suits from non-US citizens anywhere in the world?

It’s because such suits have implications in foreign policy, which is the purview of the Executive...
For example, If the U.S. freezes Iranian assets (public and private) to try and coerce them into not developing nuclear weapons, isn’t that policy undermined when those assets are raided by the courts to compensate people who sue Iran in U.S. Court?
If we allow that, what was the purpose of freezing the assets? Why not just confiscate them?
