When President Barack Obama officially named Elena Kagan as his nominee to replace Supreme Court Justice John Paul Stevens, he called the solicitor general and former Harvard Law School dean "one of the nation's foremost legal minds."
Many other American minds, meanwhile, were focused on a less lofty matter. They wanted to know about her sexuality.
The origin of that question, though, isn't what some might expect.
Speculation about Kagan's sexual orientation has frothed just beneath discussions about her qualifications ever since she emerged as a likely court pick. Obama's announcement this morning brought it to the fore. Reporters peppered White House spokesman Robert Gibbs with queries about how rumors that Kagan is gay could impact her Senate confirmation hearings. And according to Google Trends, "Elena Kagan Husband" and "Elena Kagan Personal Life" were among the site's 10 hottest searches throughout much of the day.
The very fact that both traditional media and the blogosphere are asking "Is she or isn't she?" is seen by critics as evidence of a conservative whisper campaign aimed at tainting the nomination before it even gets off the ground.

To think that this type of appointment is in the best interests of this nation's natural born citizens is delusional. Let's round out the SCOTUS's membership with the inclusion of Chaz "Chuck" Bono and Rosie O'Donnell. They are people of the highest legal intellect. Trust me. I say so...
