Jolly Rancher Lands Fort Bend County Third-Grader in Detention for a Week

A third-grader at Brazos Elementary was given a week’s detention for possessing a Jolly Rancher.

School officials in western Fort Bend County are defending the seemingly harsh sentence. The school’s principal and superintendent said they were simply complying with a state law that limits junk food in schools.

But the girl’s parents say it’s a huge overreaction. “I think it’s stupid to give a kid a week’s worth of detention for a piece of candy,” said Amber Brazda, the girl’s mother. "The whole thing was just ridiculous to me."

Leighann Adair, 10, was eating lunch Monday when a teacher confiscated the candy. Her parents said she was in tears when she arrived home later that afternoon and handed them the detention notice.

According to the disciplinary referral, she would be separated from other students during lunch and recess through Friday.

Jack Ellis, the superintendent for Brazos Independent School District, declined an on-camera interview. But he said the school was abiding by a state guideline that banned “minimal nutrition” foods.

“Whether or not I agree with the guidelines, we have to follow the rules,” he said.

The state, however, gives each school discretion over how to enforce the policy. Ellis said school officials had decided a stricter punishment was necessary after lesser penalties failed to serve as a deterrent.

Ellis said failing to adhere to the state’s guidelines could put federal funding in jeopardy.

According to the Texas Department of Agriculture’s website, “The Texas Public School Nutrition Policy (TPSNP) explicitly states that it does not restrict what foods or beverages parents may provide for their own children's consumption.”

Here it is - the wake up call - Don’t blame the enforcers !

Blame the jackasses that foisted that POS rule on them !

Of course the jackasses put in wiggle room wording to cover their own asses so they can leave blame behind on the enforcers.

These people need to be terminated, lots of terminations in the public “education” arena. They’ve gone way past reasonableness. Even my generation had some issues with overreactions but this is ridiculous. Good grief.

Clean house.

What a weird reaction!

My sister's been married for twenty years, to the father of her two children, and she has a different last name than her husband and kids.

Why on earth, in the face of typical stupidity by some government stooge, would you worry about the last name of the wronged kid's mother? And to call her a "pig" no less! What is wrong is with you?

This is not a terrible punishment, especially if weaker penalties fail to impress other students. She does not have to stay after school. She can quietly read her bible or meditate on her behavior during detention.

It seems silly to take away a childs candy and punish her, especially if she had an otherwise nutritious lunch. It is none of their business, IMO. It is her parents business, not Obama's.

I’m trash too. My mother has a hyphenated last name and was and was an unmarried teenager when I was born. LOL

I get the impression the school is hiding behind the skirt of some state language.

I suspect if the child were chewing on a condom, the administrator would give them a pat on the head and send him/her on their way.

Whatcha wanna bet that the mom either voted for the nanny-staters that passed this law or doesn’t vote at all.

I’ve been married for 21 years to the father of my nine children, and I still have my parents’ last name. I was going to change it, about 10 years ago, but my mother did a lot of estate documentation where I’m a co-trustee in my original name, and it would have been a mess to re-do it all.

Maybe when my parents have died ...

ANOTHER REASON TO HOMESCHOOL

I do. My ex-wife frequently tells our children (18 & 20 y/o) “you are just like your father!”

The kids say “Thank You!”

Just one. She has her dad’s name. Her father & I were married and actually got divorced and got re-married to each other.

So, we’re a little weird maybe.

BTW I think a week of detention for one jolly rancher candy is pretty absurd. I wonder what you get for oh, I don’t know, being tardy?
