On Monday we discussed a federal judge granting bond for alleged members of the Hutaree militia group, after the lead FBI agent in charge of the investigation could not remember details of the case to recount in court. Their release has been halted.
From Courthouse News Service:
The 6th Circuit on Thursday temporarily blocked the release of nine members of a militia group accused of plotting to kill police officers and attempting to use weapons of mass destruction.
...[T]he Cincinnati-based federal appeals court granted the government's emergency motion, "pending further review and order of the court."
Why?
"They pose a danger to law enforcement and the community," said U.S. Attorney Barbara McQuade.
Here's the counter to that:
Defense attorneys dismissed the taped conversations as "fantasy and empty, inane bluster."
So what happens next? From The Detroit News:
The 6th U.S. Circuit Court of Appeals could rule today whether it will side with a federal judge who says the accused Hutaree members can be safely bonded out, or with federal prosecutors who say they must remain locked up to protect the public.
What will happen? Stay tuned. We have a judge who has called the government's case "woefully inadequate." We have an alleged plot to blow people up yet no explosives were found in the raid. And we have a prosecutor who insists law enforcement and the public will be in danger if the defendants are placed into monitored home confinement.

A good example of why the government fears the lone wolf. It’s hard to infiltrate a band of one.
The 36 page opinion of the judge who originally ordered them released. Pretty amazing that a black female Clinton appointee seems to take the constitution seriously.

The lack of evidence is astounding but the feds need to justify the expense of a two year investigation and pseudomilitary raid.
Just twisting up some tin foil...
If they were Muslim terrorists they would be bonded out immediately.

FReepers have good reason to be concerned. Much of what these guys are accused of is stuff we see people saying right here all the time because we believe in freedom of speech.
Probably going to be a detention facility for those with medical needs; they can leverage off of existing facilities and staff at the VA.
>>FReepers have good reason to be concerned. Much of what these guys are accused of is stuff we see people saying right here all the time because we believe in freedom of speech.<<
That’s exactly what I said.
Maybe it’s a MI thing, but I know lots of people like these guys. Not a single one is planning to kill cops, unless they shoot first and threaten their families. Al la Waco.
Defendants’ counsel should have filed a Motion for Summary Judgment in their favor, based on lack of evidence as indicated in the trial judge’s statement.
It’s not just a MI thing. Not at all. We moved south (from MI) some years ago. If anything, the feelings are stronger in these parts.
I gave the feds the benefit of a doubt till I saw the evidence (in this case the lack of evidence)
These guys may be a bit loopy but even that becomes doubt full when you look at their history in Judge Roberts opinion. Most of them have never had so much as a speeding ticket. The only ones who have a police record or history of drug use are the two from Ohio.
The judge repeatedly slapped the feds all through her opinion for basically lying. The feds accused them of using firearms in the comission of a federal crime but the judge points out that all were arrested without resistance despite easy access to weapons. The feds accuse them of plotting to use WMDs but the judge again points out that the feds never found evidence.
Our judicial system is wise to the Holder lie approach. Holder may have that work in California, but not in Michigan. The fact is that this is a political show trial designed by Holder to show the nation how dirt poor white trash are the new right wing "ni---rs of america." This is designed to have a unifying effect on the combined racial minority lobby that Obama expects will elect him into a second term.Secondarily it is designed to slow the swelling ranks of the constitutional state militia all across the country.
I mean Al Furqua has the means to attempt to overthrow the US government, they have motivation, means and opportunity. Why are they not being investigated in their 12 training camps dotting the countryside?
The Hutteree are dirt poor farmers who could, on a really good day, muster enough financial resources to overthrow a trash can.
My bet is the the FBI, and its Muslim syncophant AIC from NYC, thought they would come away with a huge propaganda victory and 7 white trash body bags.
Then we watch the fed stand on the Times Square Muzzie attempted bombing! They were oh so careful to read him his Miranda rights and launch a propaganda storm about how he was so mistreated by America? Well one could say that the Huteree 9 have been more mistreated by Obama and by America. We have 10% unemployment and no jobs, and they can't follow their dreams! But curiously all the Huterees did was talk overthrow of the US government , but THEY DID NOT TRY TO BLOW UP TIMES SQUARE. Millions of us talk about overthrowing the Obama Junta and his shadow government.
Turn the nine lose. They are innocent.
Or give them jobs as armed guards protecting Times Square and tell them to shoot to kill, Islamofascists like Shazad who would have killed innocent men, women, and children in a singular act of genocide.
Wow, really?
I know there are groups like this in OH too.
Unless the FBI can provide the court with sufficient evidence that these people are a direct threat then their federal custody is nothing more than as political prisoners.
More government “agents provacateur” creating crimes that wouldn’t exist naturally.
I'm getting flashes of possible real live counterparts to Wilson Blair or Bob Bullard here.
It is not feasible to think of all those areas with trailers & huts—around ponds & lakes, filled with trucks, old cars, small boats & retirees, crowded ‘everyone knows everyone else’s business’ neighborhoods—being a secretive ‘hotbed’ for anything.
