Obama Won’t Enforce Existing Immigration Laws

President Obama criticized Arizona's new immigration law, saying it was caused by inaction in Washington—specifically, the unwillingness of Congress to pass an amnesty law. He's right about the geographic location of the problem, but not about how to start fixing it.

The chief culprit right now is the President himself, not Congress. While there are numerous changes to the law that should be made, the most urgent task before us is to enforce the laws already on the books.

The administration can do plenty without new laws

Repair the Fence

Start with the fence. People sometimes exaggerate the importance of fencing, imagining you can set it and forget it. Actually, it requires constant maintenance and policing, but it does represent an important tool for the Border Patrol. Congress in 2006 required the construction of more than 700 miles of double fencing along the border with Mexico. The administration has said that construction is virtually complete—except that much of the new "fencing" actually consists of one layer of vehicle barriers, which can prevent a vanload of illegals from driving into the country but stop no one from hopping over them. Ending its opposition to real fencing would be the first priority.

Prosecute Illegals

Also at the border, the President could expand Operation Streamline, an initiative to prosecute every illegal alien caught along certain small sections of the border and lock them up for a few weeks or a month before returning them. The goal is to exact a penalty for border-jumping. Most people who are caught are now sent right back with little or nothing in the way of consequences.

Workplace Raids

Of course, border enforcement doesn't end at the border. Making it hard for illegal aliens to find and keep jobs is at least as important, because without the magnet of jobs, illegal immigration becomes much less attractive. The President has all but ended raids at worksites, replacing them with audits of companies' personnel records to look for illegal workers—who are fired, but not arrested. Audits are a great idea, but there need to be raids as well, if enforcement is to be taken seriously. And Obama doesn't need permission from Congress to re-start them.

Check Social Security Numbers

Also in the area of employment, the Social Security Administration and the IRS currently know of hundreds of thousands of illegal aliens who have used fake or stolen Social Security numbers to get jobs or file for tax refunds. But the agencies don't tell anyone, supposedly because of their interpretation of privacy law. Here again, the President could act without action by Congress and instruct his agencies to inform employers when they submit a fake or stolen number from a new employee and insist they take steps to clear up the situation, including ultimately firing. Also, in cases of identity theft, the President must require the agencies to inform all those claiming to have the number that it's being used in multiple locations, so the real owner can take steps to stop it.

Use Local Police

In the area of policing, Congress created in 1996 something called the 287(g) program, which trains local police in the finer points of immigration law and effectively deputizes them as immigration agents. This allows local police to start the processing of immigration violators and enhances federal-state-local cooperation in immigration enforcement. This administration has tried to cut back this program and discourage new enrollments; the opposite is required and is within the administration's existing authority. What's more, the administration can launch less-intensive, perhaps web-based, training in immigration law for local police, so they'll be able to tell the difference between a green card and an employment authorization document, among other things, hugely improving their ability to spot immigration lawbreakers and not hassle legal immigrants or visitors.

Track Visa-holders

And border enforcement isn't even all on our own territory. About one-third of illegal aliens came in legally, with visas, but never left. In 1996, Congress mandated the development of a check-in/check-out system at the border, so we'd know which visa-holders left and which had overstayed. Nearly 15 years later, this still hasn't been completed, and it's not clear anyone in the administration even wants to do this. Again, this is in Obama's power to change on his own, with no new laws.

And a further step back takes us to the visa offices themselves in our consulates overseas.

Although the law specifically says all visa applicants are to be assumed to be potential illegal aliens until they prove otherwise to the satisfaction of our State Department employees, the reality is very different. Too many refusals can potentially jeopardize a young Foreign Service officer's career, while freely granting visa applications to people likely to end up as illegal aliens causes little disquiet from superiors. This, again, is matter of misguided management not inadequate laws.

Our immigration policy is indeed broken, something everyone seems to agree on. But rather than Congress’s passing "comprehensive immigration reform," we need the President to undertake some "comprehensive enforcement reform." And he doesn't need anyone's permission to do that.

Our local State Rep, an ambitious aspiring Democrat politician/lawyer, takes his sound bites, and of course money, directly from the Democratic Party, distancing himself from the local citizen outcry on the illegal freight train, by repeating "it's a federal problem."

He is told to say that, it is blatantly obvious.

And says that in the face of all the legal mechanisms that otherwise can be employed, 287(g), RICO, ICE reporting, etc.

He is told to say that essentially from the current administration, the leaders of the Democratic Party.

He is a Lawyer (not a good one, just a talking head politician) and knows without a doubt the legal mechanisms and leverage which could be invoked.

There is an agenda, at the highest globalist level, to deconstruct the United States and what it once stood for - individual responsibility within a boundary of national sovereignty.

It is true that GWB, and Clinton before, were party to the agenda, they could not help but know. How powerful it is across the globe, as opposed to the human consciousness of individual freedom and responsibility, we are witnessing. The jury is out.

As repeated here many times on FR what happens in politics is hardly accidental, it is intentional:

"You may not be interested in Politics, but Politics is interested in You." - Trotsky.

Having worked in government many years, at many levels, the yes-man who is its instrument, just like our local politician, enables the highest level agenda's of even the most corrupt or misguided "leaders." The yes-man syndrome pervades the entire system from top to bottom. That is why for instance the Soviet Union could have a mighty military - there is no necessary intrinsic "value" of individual dignity in the military, any more than in a cabal of avaricious lawyers; you just fill the heirarchy with yes-men.

Besides the institutionalized yes-men there exists of course a set of truly naive, ignorant, stupid, supporters who are mustered by craftily applied psychological operations. For instance the pervasive "white guilt," manifest in the overwhelmingly white vote of Oregon and Minnesota, being applied for Barack Obama - a irrefutably documented leftist (or Communist). So that there are two components of Leftism, the power-obsessed institution of yes-men, and the truly obtuse. It is a formidable enemy of the human spirit.

This is why the centralized federal government must be dismantled to no more than 60% of its current authority. The basis of the Tea Party.

And there are many who maintain there is no "global conspiracy." Then just what does that concept mean?

It is becoming more apparent every day. The fincancial reform bill seems to be a big part of this. There is a concern they will somehow not allow elections in November, or some crisis will be orchestrated this summer.

Perhaps those under federal indictment for any variety of infractions could file a class action lawsuit nullifying their indictments because the federal government is ‘selectively’ prosecuting them for their infractions while at the same time ignoring other federal laws on the books?

True enough, but if they fail at immigration reform this year, there’s not a snowball’s chance in hell he’ll get to pass it with the Republican Congress he’ll face starting in 2011. I do worry that his claim not to try and tackle immigration reform this year is a feint and that when the handwriting is on the wall Nov. 2, he’ll order Congress back for a lame-duck session to ram through immigration reform, an energy bill and VAT during the last fleeting moments of a Dem majority.

The Dems have proven adept at bending or breaking the rules. All they have to do is pretend that these measures are budget-related and they can use the same reconciliation Mickey Mouse that they did with health care reform. Since cap and trade will increase government revenues, hence theoretically reduce the deficit, I don’t think it would be that hard for the energy bill. Same with VAT.

Honestly scored, I see no way they could do that with immigration reform unless they really stretch out the waiting period for eligibility for health benefits and other government programs. If so, then the new taxes being paid by illegals emerging from the underground economy again would arguably improve the deficit picture and be a candidate for a reconciliation package.

It represents a multiplication of his vote base. It is a vote bank. Nothing more nothing less.

Of course he is going to be in support of reconquista.

If you ask me, Inner City African American preachers should get out there and read Obama the RIOT ACT in support of those unemployed in their communities. But would they truly stand up for their people and for the United States? One wonders.

You may placate the ultra-libs, but the majority of the electorate [in general] has moved center to center-right.

You’ve given us the economy, healthcare, and NOW “immigration” as issues.

Keep it up - you’ll just about put your party out of power in both Houses in 2010, and definitely by 2012.

Great listing of 0bozo the commie pig could do right now to stop or deter illegal aliens from entering our country, or to deport them when caught, without needing any new laws on the books. Get started 0bozo & enforce the existing laws!!!

But when 0bozo himself is very likely breaking the law as a non-U.S. citizen or at the very least a non-natural born U.S. citizen, then you can see how this usurper would have no qualms about thwarting or not following current immigration laws already on the books.

I wish that the GOP would grow some balls and hammer 0bozo on following the current laws already in place.
