Army to 'inquire' into charges against Lakin

The U.S. Army says it will "inquire" into the "truth" of the charges filed against Lt. Col. Terry Lakin, who has refused to follow orders until Barack Obama documents his eligibility to occupy the Oval Office, and ultimately will "determine what disposition should be made of the case in the interest of justice and discipline."

WND reported Thursday when the formal counts against Lakin were filed without comment by the Army.

The counts, posted on the SafeguardOurConstitution website, which is generating support for the officer, allege violations of the Uniform Code of Military Justice Articles 87 and 92.

Lakin publicly asked the president to document his eligibility and expressed a willingness to deploy with the 32nd Cavalry Regiment to Afghanistan. But he received no response from the White House.

The filing of charges, however, may be part of the still-unrevealed strategy Lakin and his legal counselors are pursuing.

From the article:

Today, Army spokesman Chuck Dasey told WND via e-mail that the charges were "preferred" by the Medical Center Brigade Headquarters company commander.

The charges then were forwarded to the acting Medical Center Brigade commander, who directed the appointment of an Article 32 pretrial investigation "to inquire into the truth of the matters set forth in the charges and to secure information to determine what disposition should be made of the case in the interest of justice and discipline," Dasey wrote.

He said the investigation will be scheduled when the investigating officer gets the orders.

What does this mean? Does this mean they (Army) are possibly backing off the charges against Lakin?

...so far Obama has been successful in stonewalling these challenges...but they keep coming...and eventually one of them will turn into this era’s version of Watergate...mark my words, there’s a reporter out there somewhere that wants a Pulitzer...there’s a judge that wants to be famous...there’s a lawyer that wants to be a crusader...it’s gonna happen sooner or later.

Please God, hear my prayers. I pray that there is enough decent American and honorable men in high enough ranks to stand with Lt. Lakin in this. I pray they find it uncomfortable if not downright frightening that questioning a leader’s valid and legitimate right to order a soldier to war is met with punishment. I pray that someone, somewhere, stands up to the man who is not concerning himself in the least with the rules of engagement that is getting our men and women killed in record numbers while engaging in surrender talks with the Taliban.

In Jesus name, I pray.

I’ve always had 60% skepticism that this ‘Birth Certificate’ charge was valid. Now I have 60% skepticism that the charge is ‘not valid’.

I predict that this charge will again re-insert itself into the 2012 elections, and after ZERO having burnt his Messiah masquerade from his thuggish antics these past two years, will not have the fool’s shield to keep this charge from sticking this next time around.

In spite of the GOP being a horrible party (only looking good in comparison to the more horrible Democrats), I hope Obama isn’t shown the door until after the GOP has control of Congress.

Well -- this will be interesting.

Will they dispose of the "truth" in order to get there or will they require the "truth" from all parties who took an oath to uphold the Constitution, including themselves, and follow that "truth" to its logical though perhaps unpleasant destination???

Not only this above, but Obama has distracted the Department of Justice and its U.S. attorneys from their important work of getting the “bad guys”. He WASTED their resources and time in an effort to block the release of **common** documents that unanointed Americans provide routinely for many reasons. Obama did this at a time when plots were being laid to blow planes out of the sky and KILL our soldiers on their bases and recruitment centers.

Obama has also appointed U.S. attorneys who have defended terrorists and who are sympathetic to their cause! UNBELIEVABLE!

If Obama is doing all of this as way of playing the dirty trick of “gotcha” on the birthers...well...I don't think the American people will be amused.

I guess it’s up to interpretation.

Are they going to investigate Lakin’s claim of Obama being ineligible?

Or are they going to investigate Lakin missing movements, ect.?

I don’t have a clue how military justice works but I wonder if this case doesn’t give some investigator the power to see Obama’s birth certificate if he chooses to go down that avenue.

Wouldn’t the military want to know for certain that Obama is CIC in case a judge did allow Lakin discovery?

Let’s just hope that those that do stand with him are not in the medical field. I think it’s bad enough to be losing one experienced combat surgeon from where he is needed, I hope there aren’t any more.

Thank you, Lt. Col. Terry Lakin, for your patriotism, for living up to the letter and spirit of the oath and for being an example of doing the right thing regardless of the price you have to pay. Someone had to do what you are doing.

I don't think so. It's the normal process. It's different, but not that much different than the civilian criminal justice system process. The charges have been filed. This is analagous to a victim of a crime filing criminal charges. The next step would be an investigation by the local DA's office into the validity of the charges. In this case it would be into whether he actually disobeyed the orders and missed the movement. Aside from the bureacratic paperwork, and the military is very bureacratic, the investigation should not take long. Probably just interviews with the person who gave the orders, and the command he was supposed to report to. For the missing movement charge, they'll have to establish that he did not take the flight. Since he's not at Ft. Campbell, and his ticket was not used, that too should not take long.

Next in the Civilian system would be the DA taking the case to the grand jury. There is an analogous process/hearing in the military system.

The whole process is very formal and will take longer than you or I might like, but due to other factors, it probably won't take as long as a low to medium level felony case in a busy urban jurisdiction might take.

Why? After Nixon resigned, in August of '74, the Democrats won big time in the November elections, leaving Gerald Ford with an even more Democrat Congress. Then in '76, we got James Earl "Mr. Peanut" Carter, for President.

Thus the fallout from The One becoming "former", would reach both the '10 and '12 elections, and would increase the chances of a Republican takeover of Congress. Increase them a lot.

It would also mean that Biden, or whoever became President, would be "credited" with a full term, under the XXIInd amendment. Not it would be at all likely that the person would be elected in their own right in 2012. However he would present a very weak opponent for the 2012 race, just as Gerald Ford was in '76.

The only advantage to "the end" being after January of '11, when the new Congress was seated, would be that the new Congress, rather than the old one, would provide the confirmation of the selected VP replacement required by Amendment XXV.
