Blagojevich Judge Calls Emergency Meeting

The judge presiding over former Gov. Rod Blagojevich's corruption trial called an emergency meeting Thursday evening after information that was intended to remain under seal was released to the public in a defense filing to subpoena President Barack Obama.

Judge James B. Zagel scheduled a 6 p.m. hearing in his chambers to question attorneys about why the redacted information was readable, according to reports.

But Blagojevich's attorneys denied that interpretation. When asked whether the meeting concerned the redacted documents, attorney Sheldon Sorosky responded simply "no."

The defense motion, filed Thursday afternoon, request to call President Obama as a corroborating witness and argued that Obama could verify that Blagojevich didn't try to sell his seat.

The filing contained several paragraphs that had been blacked out electronically. However, the underlying text was easily viewable in the electronic cersion of the document if a reader simply copied-and-pasted the paragraphs into another program.

The failure to properly redact is a relatively common one in government circles.

BINGO!!! I found the original posting here at FR... It was through HillBuzz (must not have looked back far enough), but was posted on HillaryClintonForum.net originally (where I read it).

Here is the FR post speaking of Fitzpatrick and the apparent RICO investigation of ACORN that would supposedly indict Pelosi, Reid, Obama, Dean, etc...

I dunno, I’ve seen Blago looking 0 dead in the eye in numerous pics and Blago always seemed to have the upper hand.

I hope and pray something will come of this.

Isn’t this a monster story getting no ink anywhere except a few threads here?

That’s why Biden won’t be running in 2012. It’ll be Hillary.

I’ve always considered the Fitzgerald persecution of Scooter as an audition for the AG position in a future clinton administration. (It was either Fitz or Gorelick, with the second prize being Solicitor General.) Maybe he doesn’t think the audition is over yet and is trying to clear the deck for hillary! in 2012.

OK, I think I’m turning in for the night — have a couple dr. appointments in the morning for myself and my daughter.

I’d check the Chicago papers in the morning — I do know via a post on this thread that it made the evening news in Chicago... Seems like the only place the media is writing on this are on station and paper blogs at this point... Maybe we’ll see more tomorrow? Getting close to the weekend though — look for something big from Obama’s campaign to try to knock this story out of ALL the papers (if it makes it in tomorrow to begin with...).

Would have LOVED to be a fly on the wall in the judge’s chambers earlier tonight! I’ll bet a total *gag* order is next. I hope not, but if we’re dealing with a judge appointed by Reagan, I don’t think he’s going to let the DNC turn his courtroom into a boxing arena.

Gosh.. too many ways this could twist and turn. As I said on another site today — if this doesn’t turn out in one of the ways I’m seeing I’ve got a good plot outline for a political thriller novel in my head! ;)

What probably will happen is that Blago is exonerated and later pardoned by the Obama administration. Then Blago turns around and sues the state of Illinois for slander and back pay.

In the public market, Blago is brilliant. He’s a politician so of course he can’t do anything else. If he could he’d be doing it already.

James B. Zagel (from the October, 1991 evaluation)

Judge Zagel, 50, was appointed by President Reagan in 1987, on the recommendations of Representative Michel. He graduated from Harvard Law School in 1965. Judge Zagel was an Assistant State’s Attorney in Cook County upon graduation from law school. From 1969 to 1977, he was an Assistant Attorney General in Illinois, except for six months in 1975, when he was Chief Assistant to then-Arizona Attorney General Bruce Babbitt. In 1977, Gov. Thompson named Judge Zagel Executive Director of the Illinois Law Enforcement Commission, and in 1979 he became Director of the Illinois Department of Revenue. In 1980, he became Director of the Department of Law Enforcement, which later became the Department of State Police.

Judge Zagel is an intelligent, tough-minded jurist. Lawyers report that he knows the law well, understands the issues that are presented to him, and easily separates the wheat from the chaff. He is capable of writing good opinions, and can work hard on a particular case. Most lawyers report that he conducts trials well, and that he has a good temperament. Lawyers generally describe Judge Zagel as diligent, although there are some complaints that he can be slow to decide motions.

Judge Zagel has a very large backlog of pending civil cases. Some lawyers ascribe this to his willingness to allow attorneys to set their own pace for a case. If lawyers do not wish to push a case is trial, he is more willing than some judges to tolerate delays. On the other hand, if lawyers are pushing a case forward, he is usually willing and able to accommodate them. He can be creative and interventionist in moving cases along, and is effective during settlement conferences..

While most lawyers view Judge Zagel as fair, some lawyers are concerned that he will bring a political agenda to bear in certain classes of cases. He is viewed as very prosecution-oriented. He is also viewed as unsympathetic to civil rights plaintiffs. Many lawyers claim he will stretch the law to meet his political views, or his own notion of what is fair in a particular case.

With Judge Zagel’s skill and creativity, he should be capable of reducing his backlog and keeping his docket more current. On balance, most lawyers consider him to be a very good judge.

I found this information on him. Not sure if being appointed by Reagan it meant that politically he is conservative? Tough to tell since he went to Harvard which to me is a bad thing!

Actually, it’s still at HillBuzz. The original link to the FR thread was to a message board which was discussing the article FROM Hillbuzz... (Once I had a date it was a lot easier to find... They had at least a dozen posts on October 9, 2008 — many to do with Obama and the ACORN investigation)
