The defense attorney for an officer refusing Army orders until Barack Obama documents his eligibility to be commander in chief has hinted that the president's proof of eligibility could come up during the course of the government's prosecution of his client.
"In the UCMJ (Uniform Code of Military Justice), just as you would expect, criminal defendants have the process of the court, for subpoenas and depositions under the rules that are prescribed," attorney Paul Jensen said during an interview today on the radio show of G. Gordon Liddy.
Jensen was on the program with his client, Lt. Col. Terry Lakin, who posted a YouTube video inviting his own court-martial because he believes military orders under an ineligible president are illegal, and then posted a letter telling Obama that it's up to him to provide the proof.
"I'm not going to say what we are going to do other than we are going to do what you would want us to do," Jensen said.
He specifically avoided broadcasting any specific defense strategy for the case that is developing against Lakin confirming that the officer was told in writing on Monday that he now has been "flagged" by the military and charges are expected to be filed soon.

Robert Bauer of Perkins Coie top lawyer for Obama, Obama’s presidential campaign, the Democratic National Committee and Obama’s Organizing for America is the same Washington, D.C., lawyer defending President Obama in lawsuits challenging his eligibility to be president.
Bauer’s warning was dated April 3 and delivered via letter to the plaintiff’s attorney, John D. Hemenway. It is not the first such warning issued. Lawyers trying to kill a similar California lawsuit filed on behalf of Ambassador Alan Keyes also said they would seek sanctions against the plaintiff’s attorneys in that case unless they left the issue of the president’s eligibility alone.
“For the reasons stated in Judge Robertson’s ruling, the suit is frivolous and should not be pursued,” Bauer’s letter warned. “Should you decline to withdraw this frivolous appeal, please be informed that we intend to pursue sanctions, including costs, expenses and attorneys’ fees, pursuant to Federal Rule of Appellate Procedure 38 and D.C. Circuit Rule 38.”
The FEC report also reveals Obama For America has spent nearly $9.5 million in the first three months of this year of which $6,365 in legal fees paid by Obama For America also went to Oldaker, Biden & Belair, a firm founded by Joe Biden’s son, Hunter Biden.
This is just partial. As you have stated on other threads, there have been 40 actions that have required representation by Attorneys on behalf of Obama. It is not unreasonable that this total has reached or exceeded $2 mil.
Perkin and Coie, have remained his attorneys, and are still on retainer according to Mario Apuzzo and the filings with cc to P&C
The threats and innuendo by attorneys representing Obama are not free, every statement costs.

While it is clear that Obama's campaign has spent a considerable amount of money on lawyers, it is not clear how much of that money has been spent on birther court cases.

I want to know where he got the money to pay for it. When he became president, he was not a millionaire, and his salary is under $300k/yr.
