Van Irion, Constitutional Attorney and candidate for the 3rd Congressional District of Tennessee filed a constitutional challenge to the Patient Protection and Affordable Care Act yesterday at 2pm at the United States District Court in Chattanooga, TN.
Irion said he considered taking this step after his trip to Nashville last month to support the Health Care Freedom Act and other bills proposed to protect Tennesseans against Obamacare. It became evident to me that the Attorney General was unlikely to take action. Tuesdays announcement simply confirmed what I suspected.
Irion says that the AGs analysis misses the point. Mr. Cooper bases his conclusion about the constitutionality of the Tennessee state bills on the assumption that the Patient Protection and Affordable Care Act is per se constitutional. That is the very issue at stake here. Is the PPACA constitutional or not? If not, then states have every right to defend themselves from its enforcement.
Irion s suit will be challenging the constitutionality Patient Protection and Affordable Care Act on behalf of a lead citizens of Tennessee. He says that individuals, companies, and groups wishing to join the suit as plaintiffs can contact him personally at

Complaint filed 4/8/10 in the United States District Court, Eastern District of Tennessee
The complaint is a notice to the defendants, Barrack Obama, Nancy Pelosi, Harry Reid and the United States, of the nature of the claims. The complaint does not require or contain a full legal argument at this stage. A complete legal brief of the unconstitutionality of Obamacare will be made after the defendants answer the complaint.

Van Irion is running for Zack Wamp’s seat. Zack is leaving the house to run for Governor of Tennessee. Van’s a solid candidate who’se views are conservative. I’ve met him once, and hope to do so again.
I’ve signed on to this class action suit. I don’t know whether it will bring about any positive result or not, but just having a huge number of signatures is a good indication of the strong sentiments against the government takeover of health care that we’re witnessing in the new USSA.

On a side....I would like to remind anyone living in Van Irion’s 3rd District in Tennessee that he is running for Congress. I am an Ohio resident, but after signing the suit, I reviewed his website, exchanged some correspondence with him and am decidedly wishing there were many more Van Irions out there. I hope that other Freepers would also find him to be an excellent conservative candidate deserving of support in November 2010!

Sortof the way I look at it. Besides, as an early boomer I feel a sense of responsibility and an obligation to aright the malfeasance we allowed our "leaders" to get away with. Much of the damage to our country happened on my watch and it gives me no small amount of heartburn. If that sense of obligation puts me on "lists", I'm ok with that. Much worse could happen.
