Under this act, any new legislation that proposes a mandate on state and local governments estimated to cost more than $50 million dollars must have a Congressional Budget Office (CBO) estimate and provide the funding to pay for the mandates.
How many states are going to have to deal with unfunded mandates that far exceed $50 million dollars and into the tens of billions of dollars each year and pertain to a host of services that will have to be funded by the federal gov't under ObamaCare?
If the unfunded mandates are funded, that would skyrocket the actual cost of ObamaCare.
Something else to add to the mix:
1.) The commerce clause deals with the regulation of commerce. How can the gov't regulate commerce if someone doesn't engage in commerce?
2.) How can the gov't force people to buy and sell and work jobs to buy and sell and engage in commerce? The gov't cannot force someone to work, so they cannot force them to engage in commerce.
Given the commerce clause deals with the regulation of commerce, the gov't therefore cannot force anyone to purchase health insurance coverage under ObamaCare, per 1 & 2.
BUMP
You’re welcome! :-)
I haven’t yet....but I’ll check it out. Thanks!
It doesn’t make a lot of sense and is pretty much rhetorical - but I want it on the record anyway - is THIS law why the House had to wait on the CBO estimate? And IF SO.....was there confusion, or was the CBO ordered to come up with a ridiculously low number in order to satisfy the law on paper, thus allowing the vote (and breaking a few other laws in the process?
I'm a woman and can guarantee that I no longer have the right to control ANY part of my health, thanks to ObamaCare.
Excellent post.
A Contract With America item - 1994 Republican Revolution:
The Unfunded Mandate Reform Act (Contract With America item): Passed by the Congress March 16, 1995, it put an end to the practice of passing regulations and laws to states without giving them the money to pay for them
What is the risk of bureaucrats mandating abortions to save money?
please help and give what you can. www.repealthehealthbill.org
If I recall correctly, during the house vote, documentation was provided for the record denoting health care as a constitution right.
The unfunded mandates relief act of 1995 does not apply to any legislation before the congress or a proposed or final federal regulation that enforces constitutional rights of individuals.
So the SCOTUS gets to decide if health care is a constitutional right.
I’m glad BHO pissed off the SCOTUS during the SOTU speech.
Mr. McCLINTOCK remarks to Mr. Speaker:
Fortunately, the Constitution still protects our freedom from such usurpations. It will fall to the Supreme Court to hold this act accountable to the Constitution and it will fall to ``We the People’’ to hold those responsible for it accountable at the polls.
They will say that oh well there is also the general welfare clause.
In which we can ask, That statement is the welfare of the US - not individual citizens. The welfare of the US means that it must not harm the government and individuals without insurance doesn’t harm the government it harms private businesses who do not get paid.
If INSURANCE can not be a right because you don’t automatically die if you do not have insurance, nor do you automatically live if you have insurance.
You could make a greater case that FOOD AND WATER is a right and we must force people to buy government controlled food and water.
It is from the very first paragraph...
We need to also send it to the Doctors Association in NJ that filed suit in Fed Court in Newark.
Sorry.... where are the links?
Does anyone have a Cliff Notes version of the status on the State AG's lawsuits filed, or Mark Levin's lawsuit, or any of the other lawsuits filed to contest 0bozoDeathCare as unconstitutional & hopefully thrown entirely out? Are these lawsuits going to be heard quickly by especially SCOTUS, or is this a 2-3 year ordeal? By then 0bozoDeathCare is institutionalized and will never be rolled back by the cowering SCOTUS or any appeals court for that matter!
Section 1553 on page 360 of the Senate Bill states: Prohibition against Discrimination on assisted suicide. (What does assisted suicide have to do with health care?)
Section 1553 establishes the Office of Civil Rights of the Department of Health and Human Services to receive complaints. So if your doctor, who is bound by the Hippocratic Oath to do no harm, will not KILL you, you can sue.

Please give me some linkage.
Satan’s (yes the ACTUAL Satan) fingerprints are all over this thing!
Excellent.
