Sounds like another vote was necessary for each instance of the violation... and some of the businesses involved might have something to say about such a vote for the congress critters in their districts.

United States v. Lopez (1995)Also, we should all be familiar with Bailey v. Drexel Furniture Co. 259 U.S. 20 (1922). Perhaps the strongest words from that opinion are: "But there comes a time in the extension of the penalizing features of the so-called tax when it loses its character as such and becomes a mere penalty with the characteristics of regulation and punishment. Such is the case in the law before us."
We are WELL overdue for a re-affirmation of the meaning of the 10th Amendment in the REPUBLIC of the United States. As all FReepers know, we are a REPUBLIC, not a Democracy.

This Act shall not apply to any provision in a bill, joint resolution, amendment, motion, or conference report before Congress and any provision in a proposed or final Federal regulation that
(1) enforces constitutional rights of individuals;

(3) requires compliance with accounting and auditing procedures with respect to grants or other money or property provided by the Federal Government;

(5) is necessary for the national security or the ratification or implementation of international treaty obligations;
(6) the President designates as emergency legislation and that the Congress so designates in statute; or
(7) relates to the old-age, survivors, and disability insurance program under title II of the Social Security Act (including taxes imposed by sections 3101(a) and 3111(a) of the Internal Revenue Code of 1986 (relating to old-age, survivors, and disability insurance)).

The best way to defeat this bill...is just to tell more and more people what’s in it. The more people learn about what is REALLY in this bill (no, it isn’t all sunshine and roses), the more they get angry. Education is the answer. Keep getting the word out.
