Georgia AG won't sue over health care bill

Attorney General Thurbert Baker told Gov. Sonny Perdue on Wednesday he will not file a federal lawsuit to block federal health care reform legislation signed into law this week.

Baker, a Democrat seeking his party’s nomination for governor, told the Republican Perdue that he was “unaware of any constitutional infirmities and do not think it would be prudent, legally or fiscally, to pursue such litigation. I must therefore respectfully decline your request.”

Perdue had asked Baker to join more than a dozen other attorneys general from around the country — all of whom are Republicans — to sue to block the federal legislation, which Perdue said will devastate the state budget due to increased Medicaid costs.

“I do not believe that Georgia has a viable legal claim against the United States,” Baker wrote.

His decision, he said, was based in part on the great expense a law suit would incur at a time of cratering state revenues.

“I cannot justify a decision to initiate expensive and time-consuming litigation that I believe has no legal merit,” Baker wrote. “In short, this litigation is likely to fail and will consume significant amounts of taxpayers’ hard-earned money in the process.”

Legal scholars around the country have largely opined that the lawsuits by the states face steep odds as the courts have largely protected Congress’ ability to act in this manner.

The governor should fire him for insubordination.

Its impossible to get through to Baker's office - I've called for 2 days - I suspect they've taken the phone off the hook. I did talk to Perdue's office and am happy to hear he may intervene.

Baker is TOAST

...yeah, uh huh. It’s ok to spend “hard earned money” on a “stimulous” package that was designed specifically to get dems re-elected! It’s ok to spend “hard earned money” on abortions via the “healthcare bill”. It’s ok for the Kenyan and family to jet set around the world playing golf, eating in Paris just for the hell of it and persuading a-holes to vote for this monstrocity!

But, spend “hard earned money” on preserving freedom? Never!

The courts will protect Congress' ability to order every adult citizen to purchase a service that may not be wanted or needed? Then the courts are apparently not concerned with the US Constitution.

Don’t believe that bullshit about the Republicans wanting to win. If they had been serious about winning, they would have fielded a decent candidate.

The Atlanta Journal Constitution really makes me laugh.
Every single legal scholar I have seen says there is at the very least a pretty strong case that 0bamcare may not in fact be constitutional. I don't know what “legal scholars” the AJS has been talking to. Maybe they went and talked to 0bama?

Can't! In Georgia, the AG is an elected office. That's why we have a Republican Governor and a Dim AG. Perdue has initiated a Constitutional amendment that would make the AG an appointed office and thus beholding to the Governor.
