13 STATES FILE LAWSUIT AGAINST HEALTH CARE BILL

Attorneys general from 13 states sued the federal government Tuesday, claiming the landmark health care overhaul bill is unconstitutional just seven minutes after President Barack Obama signed it into law.

The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.

If any provision of this division, or any application of such provision to any person or circumstance, is held to be unconstitutional, the remainder of the provisions of this division and the application of the provision to any other person or circumstance shall not be affected.

This is standard language in just about every significant law, including McCain-Feingold. Notwithstanding this language, if the SCOTUS invalidates the heart, brain, or guts of the legislation, the rest of the body will die.

but the mandate is really the centerpiece. without it, the whole bill is radically different. Without the mandate, the cost and impact on the deficit is up substantially. So, if the mandate is gone, a new CBO projection would likely show that the law will increase the deficit by trillions.

without the mandate, the whole concept collapses.

That’s EXACTLY the kind of attitude we need right now. If EVERY person who opposed the HC plan would have engaged, we might have killed it, but too many people did NOTHING.

Not quite. If the court finds that the unconstitutional parts of the bill are so important to the sense of the bill when left, the court will find it unconstitutional in toto.

I am ashamed of our Georgia AG. He is a liberal (read MARXIST) Democrat. He would probably sue to see health care cover buildings, cars, pets, wild animals....

Although AZ has a RAT AG who has stated he will not be suing, our Gov Jan Brewer "R" (who replaced Crappy Nappy "D" after she went to her political payoff gig under boy king) has stated she WILL be joining the law suit parade as soon as the boy king signs it into law.

All the more reason to contact him. And often. Let’s swamp his office with calls, faxes, emails. He will be running for governor so threaten to publicize his name as someone who refuses to fight for state’s rights.

What else can we do? Can we FOIA them to death like they did Sarah’s office in Alaska???
