Supreme Court Battle Quietly Brews Over Possible Future Nominations

There is a Supreme Court battle brewing on Capitol Hill -- despite the fact that there are currently no vacancies on the high court.

On Wednesday, the Senate Judiciary Committee will hold hearings to consider the nomination of Berkeley law professor Goodwin Liu to the Ninth Circuit Court of Appeals.

The hearing is expected to be contentious, showcasing the differences in judicial philosophy between the parties, with conservative senators arguing that Liu's record on divisive issues puts him outside the mainstream of judicial thinking.

Some believe Republicans are opposed to Liu's nomination because they fear President Obama may be grooming Liu for a future Supreme Court vacancy.

No ABC News, this Republican is opposed to him because Obama nominated him to the 9th Circuit, a position for which he is OBVIOUSLY unqualified, to say nothing of his outlandish prudential beliefs.

To characterize Liu's experience actually practicing law as "brief", would be generous. Not only does he have virtually no practical legal experience, he clearly doesn't have any experience as a jurist. How can anyone believe that he's even remotely qualified for a District Court seat, let alone a Circuit Court appointment? It's ridiculous, on its face.

Remember 2001. Miguel Estrada. Rated “highly qualified” by the ABA. Defeated by the Democrats in a filibuster when nominated by George Bush for the US Court of Appeals. Democrats opposed him because he did not have prior experience as a judge. He had been a clerk for Justice Anthony Kennedy plus served in a number of roles at the Justice Department. He was a magna cum laude graduate of Columbia University and Phi Beta Kappa. He was also a magna cum laude graduate of Harvard Law School where like Obama he was editor of the law review. His wife miscarried during the ugly confirmation fight.

Memos written to Senate Minority Whip Dick Durban during the confirmation process spoke to liberal interest groups desiring to keep the conservative Estrada off the court because he was a “Latino” and might be a future Supreme Court nominee. These memo’s were leaked to the press. The Dems denied any racism in the remarks.

Now the Democrats wail at the prospect of the Republicans fighting the nomination of an ultra left minority candidate who like Estrada, has not sat on the bench. This time we will hear the opposition is racist and the prospective jurist is highly qualified despite his lack of judicial experience.

The RINO’s allowed the Democrats to defeat Miguel Estrada in 2010, unwilling to fight back. Will Graham, McCain, and other Republican Senators compromise and allow an extreme leftist to be put on the fast track to the Supreme Court? McCain might fight if the nomination comes before the November elections. After November he will agree to the will of Obama in order to maintain good relations with his Democratic friends. After all for the RINO, good feelings in the club are much more important than principle.

I believe, as Mark Levin does, that it would be unconstitutional to filibuster a judicial nominee. So what? Our side should block every one of them even if the Supreme Court ends up with three justices and six empty seats.

Sounds like they are pushing some one out; so they can install their own before anyone notices. Will the Republicans be there to stop this? Are they doing anything now? Why vote on it now? There is no reason.

Watch for the PR to start coming out. Know the Democrats; know they want to kill you and your country.

What, like that "rumor" the law professor recently floated in his class, that Roberts was going to retire? Some people have speculated that this was a trial balloon.

This shows the importance of the GOP getting its act together NOW. The 4 conservatives + Kennedy will hang on barring major health issues until 2012 but another 4 years may be too long.
