Kill It In Court

Constitution: Republicans vow to repeal health care reform. But no social entitlement, once signed into law, has ever been overturned. The way to stop this federal overreach is through the courts.

Fox pundit Bill Kristol predicts that Republicans will repeal the law in 2013. Rep. Jim DeMint and other GOP leaders have already pledged to do so.

But that assumes a lot. Republicans must first regain control of both houses of Congress, which will require sustaining the current level of public outrage for six months after the fact.

That won't be easy. While additional negative details about the 2,074-page bill will come out over the coming months, the worst parts won't go into effect for years. And the White House is already reselling the few positives, such as covering pre-existing conditions, which go into effect right away.

Yes, Republicans won Congress for the first time in 50 years after Clinton tried to socialize medicine. And yes, this bill is arguably worse, with 732 more pages, 109 more bureaucracies and just as many new taxes.

But HillaryCare failed, and was cast as a major Democrat defeat. ObamaCare, on the other hand, will be hailed as a big Democrat win. Even in the off chance that they do take back Congress, Republicans seeking repeal will have to fend off all the lobbyists who will cement around new health care rules, programs and benefits.

Then they'll have to override President Obama's veto.

The nation's best chance to kill this monstrosity before it can ruin the best health care system in the world is to get the courts to declare it unconstitutional.

Amen Amen Amen! Kill this beast in court, and let the Democrats know that the Constitution’s meaning is plain and enforced. It’s the law, not a set of guidelines to be ignored.

It will not be repealed. Ever. That's why the pigs are so happy it got through, regardless of November. For cripe's sake, don't we still pay some "temporary tax" enacted to fund the Spanish-American war?

No more niceness! The States need to tell the Supreme Court that if it upholds ObamaCare, the States will call for an Article V Convention so that new checks can be put into place against the federal government and the old checks can be given some reinforcement.

How quickly you've forgotten prohibition -- not just a simple law.

An amendment to the Constitution.

Repealed.

McCain-Feingold, de-balled just last year.

And once it’s repealed as being unconstitutional they need to arrest those who voted for it on treason charges. They took an oath to protect and defend the constitution...clearly they have knowingly undermined the constitution.

What bothers me is that it seems that most of these lawsuits seek to declare certain sections unconstitutional. The problem is that if any of this bill is left standing the Democrats will surely use it as a foundation upon which to add their little bits of legislation.

Article one section eight. The 10th amendment, the equal protection clause. There are individual regulatory laws that this bill violates. There are medical privacy laws that this bill violates. If one wanted to make extreme arguments they could also say this falls under illegal search and seizure, because they are using the IRS to enforce this by looking at an individuals private records with out an individual search warrant from the court. It violates religious freedom in some cases, Like the Amish don’t believe in health insurance. We are hoping the states should take up the fight, but there should be individual law suites, class action law suites. There should be both criminal, and civil charges filed, and refilded. As of today the federal government should not only have to take on individual states in the courts, but countys, citys, municipalities, and individual citizens. In all levels of the court system. See ya in small claims court federal government.

This thing doesn’t really kick in until 2014, so we’ve got four years to kill it. It we get the Presidency in 2012, then it’s a real possibility. The Dems have now set the ground rules, everything only takes 51 votes in the senate -the fillibuster is dead. And it only takes a bare majority in the House. Get people paying taxes on a plan that doesn’t kick in for 4 year and the extra unemployment that will cause could get us there. The first real step (and test) is this November.
