i hate to say that I agree with Durbin about a cap of 250,000 on malpractice...let’s face it..if some doctor screws up your life..do you really want a cap applied to you?

It needn’t be that low, but conversely, should you be rewarded 300 MILLION?

The cap is not on award of potential earnings.

It’s not the amount of the cap, it’s how the damages are arrived at. There should be a legally recognized difference between “life is risky, be happy you’re alive” vs. “surgeon went out for a round of golf while you were in the OR splayed like a fish waiting for him”.
