No Compromise on Enemy Combatants; We’re winning because we should be winning

This is how we ought to think about rumors swirling around that the Obama administration is looking for a deal on enemy combatants and that some GOP types are listening. The compromise would be: KSM gets a military commission, but Republicans agree to close Gitmo and bring the combatants to stateside federal prisons.

This would be a terrible sell-out of our national security. It would also be unnecessary. The American people strongly support military commissions for enemy combatants — not for all terrorism cases, but for all unlawful alien enemy operatives who have no right to be tried in our civilian courts and for whom Congress has authorized military commissions.

We are winning on enemy combatants. We are winning on the fact that they should be treated like war prisoners and tried, if at all, by military commission. We are winning on the fact that they should not be Mirandized but should be detained without trial and interrogated as war prisoners. We are winning on the fact that Gitmo is a fine facility and a far better place to detain and try terrorists than any detention center in the United States. We are winning on these issues not because we are more politically savvy, but because our policies on these matters are the right ones.

BO/BS endangers our national security for his muzzy friend, who has already admitted guilt, and we are supposed to compromise? I don’t think so.

Types = RINO's = progressives = socialist = redistributionists.

Really, and I'd like to know which RINO weasels are supposedly going to appease the terrorists, compromise our national security and go along with the Bozo. Which ones?

No civilian trials for war criminals. No closing Gitmo, and no permitting alien jihadists to enter our country so the courts can order them released. Consider these not negotiable.

No. That's called surrender to Obama, Pelosi, and the other socialists. We want the terrorists to stay where they are, and Pelosi wants them in the United States. Compromise would be if we agree to bring bring the terrorists currently held in Gitmoto halfway to the United States and then release them from 10,000 feet above the Atlantic.

The debate concerning trying terrorists as criminal defendants ignores two intrusions into national defense by the Supreme Court.

The Constitution assigns national defense to Congress and President, because these branches must face citizen accountability at the voting booth. In contrast, the Constitution places no defensive powers within the unelected Judiciary.

Yet five justices in Hamdan vs. Rumsfeld did intrude, and fabricated an association of terrorists with Common Article Three of the Geneva Conventions. This construction is false because terrorists do participate in international armed conflict, lack pacific character, and do not meet any definitions for legitimate armed forces or Protected Persons. The Conventions clearly place terrorist actions beyond the pale.

These five justices also improperly intruded with their Bonemediene vs. Bush ruling. They rejected Congressional trial guidelines developed from Hamdan vs. Rumsfeld, and instead applied Habeas Corpus to enemy aliens in opposition to U.S. legal practice, English Common Law, and the Geneva Conventions.

With these rulings terrorists become citizens and enjoy a legal backdoor into our society. Their present and prospective unsurpassed butchery now equates to common civil murder. These judicial actions compare to surgical malpractice leaving a festering rag inside a body cavity. Just as such doctors should forfeit their medical practices; these justices by impeachment should forfeit their legal practices.

Instead politicians such as Barack Obama and Eric Holder now find shelter within these rulings, and indulge personal moral orthodoxies forcing America into harm’s way.

There is a vast immeasurable gulf separating the genuine people who dealt with the issues sponsoring, for example, the Geneva Conventions and the parasites feeding upon the prosperity and security so painfully forged for their benefit.

The genuine people were the parents and grandparents of the Greatest Generation. Their words expressed durable morality earned in the ultimate bloody deluges of the 20th century. The precedents for our current situation can only be derived from retrospective analysis of their words and actions.

In contrast we suffer imposters with such extraordinary mental athletic prowess as to scale unheard of heights of arrogance and ignorance for achievement of stupidity.

The void between the two is breathtaking.
