They are saying that wanting to own a fuel efficient vehicle doesn’t automatically put you in the same category as the environmentalist wackos who would be fine with arresting someone for using an incandescent bulb.
In no way is this ad an endorsement of eco-fascism. If anything, it is a warning to us to not go down that road.

Green Car of the Year, AUDI A3 TDI DIESEL, mocks "Green Police" in Superbowl ad
Gee, maybe we can have a balance of doing good environmentally, lessening dependence on foreign oil, and actually not destroying jobs and economies. Ya think?
That is Audi's point in a series of ads about the Green Police, culminating in a great ad to be seen in the 4th quarter tomorrow. Good for Audi in taking their stand.

Well, here's my two cents. I was amazed they ran the ad because it so nicely captured what the future may look like if the climate alarmists at EPA manage to seize control of the country. It was a brilliant, if unwitting, parody.
Of course, the Audi at the end was lost in all the nonsense, making it a lousy ad for selling cars, but a great ad to caution the public about what the alarmists have in store if we let them.

I know that VW diesels have been available in Ca in the past. They manage to meet emission rules. Audi is just a gold plated Volkswagen.

Absolutely in a performance car defiance sells. I think that is what they were going for, but the badly missed the mark.
And if they want to go with the clean diesel angle how about this. Imagine the Audi speeding off down the open road with a bunch of golf carts, smartcars, and seaways trailing behind and the voice over says "The Audi A3 TDI, Supporting the environment without surrendering your freedom!".
That is the attitude that sells muscle cars. Not getting happy smiles from the Green Police.
