I was thinking the same thing. Problem is that the SCOTUS doesn't have much say in day-to-day government operations.

My big question on this is if SCOTUS, being the head of the judiciary, can deny executive orders as a balance of power? Doesn't each branch of government have a balance of power; each can check the other? If so, you might see Alito and Roberts questioning Obama on Constitutionality. Which begs another question: can the judiciary subpoena for Obama's birth certificate?

Calling out the Legislative and Judicial branches in your SotU address is not only rude, it's downright suicidal.
