Top administration officials are getting nervous that they may not be able to proceed with one of their most controversial national-security moves: trying Khalid Sheikh Mohammed and four other accused 9/11 conspirators in federal court in New York City.
Last November Attorney General Eric Holder Jr. portrayed the trial as a way to showcase the American justice system to the world and to accelerate President Obama's stalled plans to shut down the U.S. prison at Guantánamo Bay.
But because of shifting political winds in Congress, the trial is now "potentially in jeopardy," a senior official, who did not want to be named talking about a sensitive situation, tells NEWSWEEK.
The chief concern: that Republicans will renew attempts to strip funding for the trial and, in the aftermath of the bombing attempt aboard Northwest Flight 253, pick up enough support from moderate Democrats to prevail.
Republican Sen. Lindsey Graham says he will force another vote on his amendment to stop the trial (which was defeated 54-45 in November) once Congress reconvenes.
"With Detroit and everything else going on, we've got a pretty good chance of winning this thing," says Graham, adding that he's privately heard from a number of Democrats, saying "they're with me."
GOP Rep. Frank Wolf says he plans a similar move in the House. "I'm afraid it's probably going to pass," says Democratic Rep. Jim Moran, who has strongly backed the administration on the issue.

~~PING!
BTTT
I thought the O.J. trial already did that.
Yeah, one look at our federal court system and the whole world will love us. Who believes this cr*pola? Holder and the Obumbler are either totally over their heads or they're trying to destroy us.
COWARDS!! COWARDS!! COWARDS!! COWARDS!! COWARDS!!
They should have thought with their brains as opposed to their a$$es before BRAVELY declaring the policy of trying these terrorits in NYC civilian courts.
What LO$ERS!!!
Obama and Holder have been reading my posts!
Bringing KSM to NY City would be the ultimate political and public relations disaster for Obama. By the time the lengthy KSM circus-trial was completed, the US public would universally see Obama as a fool. That Holder or anyone else came up with the idea shows how stupid they are.
Don’t forget Holder’s ass is in pucker mode over his whitewashing of the BLACK PANTHER’S voter intimidation farce in Philly.
ROFL
Obama is just an EPIC FAILURE !
HOLDER AND OBAMA’S SHOW TRIAL WILL COST US A MINIMUM $1 BILLION WHEN ALL IS SAID AND DONE.
Will Obama and Holder risk the funding bill votes in the House and Senate or cave ahead of time and in turn hand a victory to Bush/Cheney and the military tribunals? HAR!
What a great cartoon.... funny but even more so it is sad because this is exactly what 0bozo & Holder are doing to intimidate & destroy our nations’s security & intelligence gathering.
I just wonder that Holder gives a damn about the Panther
decision .. you think he does ?
~~~~
At least .. and that's if, God help us, there's no 2nd NYC attack, and if NYC businesses don't hit up the taxpayers for their losses due to the fear of visiting NYC.
JUST WOW....
Can it be?
Dare we even think it?
Are our Congresscritters actually starting to listen to us?
Not that I think there's any altruistic motive, if true, but more that they're sweating their next elections just a tad.
They are looking more foolish every day. They have now put themselves between a rock and a hard place and it will have no good outcome. If they have the trial in NY they will be demolished, and if they cancel it, they will be demolished. This is what happens when you try to appease your hardcore left, you find out they are a loud but tiny handful of votes, which will cost you more in support than you gain by appeasing them. They are good for primaries but useless in general elections.
The clowns are running the circus.
